Tax bureau to impose added tax on toll; group says ‘no’

CLARK FREEPORT — Despite opposition, the Bureau of Internal Revenue (BIR) announced that the 12 percent value added tax on toll fees in all expressways will be imposed starting October 1.
BIR Commissioner Kim Henares said the basis for the tax on toll fees is the implementation of Republic Act 7716 or the Expanded Value Added Tax Law (VAT law).
However, legislators of the VAT law said tax on toll fee is not included in the law.
Former Nueva Ecija Congressman Renato Diaz and Senator Ralph Recto co-authored the VAT law.
In an interview with Diaz, he said the power to impose tax belongs to the legislature and not to the revenue bureau.
“The BIR may propose taxes but only upon enactment by Congress may these tax laws be implemented by the revenue agency,” Diaz said.
Diaz, now chairman of the Center for Strategic Initiatives, said the BIR came out with the ruling by interpretation that toll fees are covered by VAT.
Senator Recto, chairman of the Senate Ways and Means Committee, filed Senate Bill 2914 clearly stipulating that toll fees are not subject to VAT.
Bills are also being filed in the House of Representatives not to include toll fees in VAT coverage.
Diaz said the imposition on toll fees will burden more than 500, 000 motorists who use the expressways daily.
“The spiraling effect on the prices of goods and services as the result of such a tax on tolls would not only exacerbate the suffering of the majority of our citizens but would impact negatively on the economy as a whole,” Diaz added.
When the BIR released the revenue regulations on the VAT toll fees last year, Diaz and former Assistant Secretary of Trade Aurora Timbol filed a case before the Supreme Court on August 10, 2010.
The case they filed sought for a temporary restraining order (TRO) against the Department of Finance and the BIR, which the Supreme Court (SC) granted.
However, the SC changed its decision on July 19, 2011 and lifted the TRO.
Petitioners Diaz and Timbol filed a motion for reconsideration along with a request to schedule oral arguments that friends of court will be invited to clarify the economic and other implications of the BIR regulation. The matter is now pending with the SC.
