Resolution on poll sabotage case vs Arroyos out by end-November

THE panel investigating allegations of electoral fraud in 2007 said it will soon come up with a resolution even as main respondents former President Gloria Macapagal-Arroyo and her husband, Jose Miguel, failed to submit their counter-affidavits.
Panel member Laguna provincial prosecutor George Dee said that they will use the last two weeks of November to evaluate the replies of 41 people named in the case filed by Senator Aquilino Pimentel III.
“In all likelihood, yes, we will be able to issue a resolution on this case (by the end of the month),” he told Sun.Star.
The panel composed of representatives from the Commission on Elections (Comelec) and the Department of Justice failed to obtain counter-affidavits from the Arroyo couple, who accused the government of President Benigno Aquino III of political persecution.
“We did not submit a counter-affidavit because it is tantamount to recognizing the legitimacy of the panel,” the former First Gentleman’s counsel Ferdinand Topacio told reporters.
Arroyo’s legal spokesperson Raul Lambino meanwhile called the panel a “kangaroo court” since the institutions have already prejudged the complaint.
“It has already prejudged the issues as commanded by PNoy (President Aquino), (Justice Secretary Leila) De Lima and (Comelec Chairman Sixto) Brillantes. The perpetuation of injustice against the Arroyos is evident and blatant and will not yet climax in the immediate future,” he said in a statement.
Earlier in the day, Topacio asked the panel to postpone the hearing because a petition questioning the legality of the probe has yet to be resolved by the Supreme Court.
But the lawyer failed to convince the panel led by Prosecutor General Claro Arellano.
“What if the SC will rule against the constitutionality of this probe? All proceedings will be rendered useless,” he said.
Last week, Topacio asked the High Court to declare the panel as illegal since it was allegedly formed to prosecute “certain persons and incidents only” especially the Arroyo couple.
Moreover, Topacio asked the court to nullify the watchlist order issued against his client, citing the department’s violation of a person’s constitutional right to travel.
The former president, who is seeking medical treatment abroad due to hypoparathyroidism and bone mineral disorder, did the same.
“That is their prerogative; we believe however their fears are unfounded,” Dee said.
The other respondents who were also summoned in relation to the probe were former Comelec chairman Benjamin Abalos Jr., former Justice Secretary Alberto Agra, former Comelec commissioner Nicodemo Ferrer, former presidential political adviser Gabriel Claudio, and former Maguindanao governor Andal Ampatuan, Sr., among others.
