Philippines urged to follow US on tobacco health warnings

A PUBLIC health law group hopes that the United States’ issuance of nine graphic health warnings to be posted in cigarette packs will have a ripple effect in the Philippines.
Last week, the US Food and Drug Administration (FDA) released among others, images of dead bodies, diseased lungs, and rotting teeth as part of the implementation of the Family Smoking Prevention and Tobacco Control Act of 2009.
Beginning September 2012, cigarette packs sold in the US will be required to carry the new health warnings.
With this, HealthJustice consultant Evita Ricafort urged President Benigno Aquino III to institute a genuine tobacco control program in the country to save more lives just like what US President Barack Obama, a former smoker, did.
The Philippines is a signatory to the World Health Organization Framework Convention on Tobacco Control, an international treaty that obliges its parties to put effective health warnings on cigarette packs.
HealthJustice said the Department of Health Administrative Order 2010-0013 that was issued on May 2010 requires cigarette manufacturers to put graphic health information on all cigarette packs sold in the country.
However, tobacco companies have refused to comply with the order, saying it violates the Republic Act 9211 or the Tobacco Regulation Act (TRA) of 2003.
Under Section 13 (g) of the law, “no other printed warnings, except the health warning and the message required (by the law) shall be placed on cigarette packages.”
Upon the prodding of five former health secretaries, the Supreme Court allowed them last March to intervene in the case of the validity of the administrative order even if they are not parties to the dispute.
“The U.S. has not even ratified the tobacco control treaty, but it will be implementing picture warnings soon. The Philippines, on the other hand, had a 2008 deadline to put effective health warnings on cigarette packs,” Ricafort noted.
But until now, the Philippines is lagging behind neighboring countries such as Thailand.
In a joint World Health Organization-Department of Health (DOH) assessment study released in May this year, it was found that approximately 87,600 Filipinos every year or 240 people everyday die from tobacco-related diseases.
The study also concluded that tobacco use is rising, especially among young girls.
Around one in four Filipinos aged 13-15 years are now smokers, compared to a 2003 level of 15.9 percent. The said study also urged the government to implement the DOH-AO 13. (Virgil Lopez/Sunnex)
