Pelayo to file motion on Luciano case
CITY OF SAN FERNANDO — Former Candaba Mayor Jerry Pelayo on Sunday said he is set to file a motion for reconsideration before the Office of the Ombudsman, after the criminal and administrative charges filed against Clark International Airport Corp (CIAC) president and CEO Victor Jose Luciano and 10 others were dismissed.
The charges rooted from the demolition of old buildings inside the Clark Freeport Zone, the materials of which were donated to Aeta groups.
“Kinakausap ko na ang ating abogado. Magpa-file tayo ng motion for reconsideration dahil malinaw naman na mayroong nakinabang dito,” Pelayo told Sun.Star Pampanga in a phone interview.
He stressed that it is not true that the buildings were indeed dilapidated and beyond economic repair.
“Na demolish ang mga buildings, nawala na lamang ang napagbentahan ng mga materiales at hindi tinanggap ng mga Aeta ang dapat sana ay para sa kanila. Mayroon tayong ebidensiya na magpapatunay nito,” Pelayo noted.
Also cleared of estafa (fraud), malversation, grave abuse of authority (oppression), grave dishonesty, gross neglect of duty and violation of the Code of Conduct and Ethical Standards for Public Officials and Employees were Silverio A. Clemente, former manager of CIAC’s Procurement, Property and General Services Department; Ruel T. Angeles, CIAC Engineering Services and Maintenance Department manager; Tarcicius T. Tiotuyco, Building and Utilities Regulatory Department (Burd) manager of the Clark Development Corporation; Burd assistant manager Angel T. Pineda; Oscar Dizon, president, Office of the Tribal Chieftains; Oscar Rivera, president, Bamban Aeta Tribal Association Inc.; Josie Gomes, Antonio Castro, Rene Soliman, and Noli De Guia.
“Complainants failed to present sufficient evidence that public respondents’ individual participation in the donation and subsequent demolition of the subject buildings were attended with bad faith, manifest partiality or gross inexcusable negligence,” the decision stated.
The Ombudsman, in its decision, explained that the donation of the building materials “originated neither from CIAC nor from the respondent CIAC officials. Records show that Luciano only acted upon the endorsements made by the PMS, PAC and the National Commission on Indigenous People on the requests of the Aeta groups.”
