Partylist solon wants GOCC law reviewed
CLARK FREEPORT—Employees of the two government agencies inside this Freeport have lauded the house resolution of Akbayan Partylist Rep. Walden Bello directing the Committee on Labor to investigate and look into the impact of Executive Order No. 7 and Republic Act 10149, or the laws on government-owned and controlled corporations (GOCCs).
Bello said he filed House Resolution 2887 so as to correct laws that prohibit the Constitutional rights of workers under the GOCCs without original charters or those state firms created under the Corporation Law of the Philippines.
In the resolution, Bello said that “the Governance Commission on GOCC (GCG’s) current interpretation of EO 7 and RA 10149 defeats the avowed goal of instilling fiscal discipline among government corporations, distorts the classification of members of the civil service, and curtails some of the workers constitutionally and statutorily guaranteed rights.”
He quoted Section 5, Art. IX-B of the Philippine Constitution which states that “Congress shall provide for the standardization of compensation of government officials and employees, including those in GOCC with original charters, while Article 244 of the Labor Code states that employees of government corporations established under the Corporation Code shall have the right to organize and to bargain collectively with their respective employers.”
The filing of HR 2887 stemmed after Akbayan Partylist learned that GCG has allegedly violated the Constitution Rights of workers in Clark Development Corporation and Clark International Airport Corporation (which operates Diosdado Macapagal International Airport) for the non-implementation of their CBAs which the workers contracted with their respective government agencies.
CIAC authorities have signed agreements with Samahan ng Mangagawa ng DMIA (SMD) of CIAC since 2010, and CDC with Association of CDC Supervisory Personnel (ACSP) in March 2012, but both agreements have yet to be implemented because of Government Commission on GOCC (GCG)’s opinion that RA 10149 and EO No. 7 prohibits that granting of salary increases and other benefits.
“It seems that the GCG’s (chaired by Cesar Villanueva, who was CDC chair of the board and CIAC director before his appointment to GCG) current interpretation of the law and the executive order is that unions operating in GOCC’s without original charter have no bargaining rights when in the same opinion, it informed the management of CDC that with EO No. 7 and RA 10149, CBAs between employees and GOCC employers may no longer be negotiated,” Bello said.
The resolution added that “this formal opinion seems to violate not only the concerned unions right to bargain collectively, but also specific constitutional and statutory provisions pertaining to the classification of employees belonging to the civil service.”
The HR 2887 also noted that on Sept 12, 2012, the GCG issued a formal position on the issue wherein it concluded that a “CBA between employees and a GOCC employer is no longer proper subject of arbitration and any and all agreements, especially those concerning increases in rates of salaries, allowances, incentives and other benefits will still be subject to the moratorium as prescribed by EO No. 7.”
It will be recalled that the Association of CDC Supervisory Personnel of CDC has elevated their case to the Accredited Voluntary Arbitrator of the Department of Labor and Employment after the state-owned firm failed to implement the agreed March 2012 approved CBA due to the existing directive of Villanueva as per RA 10149 and EO no. 7.
The union won the case as penned by AVA Froilan Bacungan stating that the RA 10149 and EO No. 7 have no repealing clause of the provision specified in the Labor Code.
