No bail set for Bella, Ian in Pique case

THE kidnapping with homicide case against the couple suspected of abducting Ellah Joy Pique was filed at the Regional Trial Court in Cebu City yesterday, five months after the six-year-old girl was killed.
No bail was recommended for Bella Ruby Santos and her British boyfriend, Ian Charles Griffiths, who are both still at large.
Prosecution lawyers Inocen-cio dela Cerna Jr. and Hazan Bargamento filed in court yesterday a pleading for a special raffle, so an arrest warrant can be issued against the accused.
The prosecution said the case must be raffled off immediately and the handling judge should issue the arrest warrant against Santos and Griffiths.
They said the case needs to be tried immediately because the respondents have “signs and high probability of flight.”
The prosecution cited Santos’ decision to sell her properties, including her Mitsubishi Pajero and her house in Inayagan, Naga City.
Judge Silvestre Maamo Jr., however, denied late yesterday afternoon the prosecution’s motion, which means that the case will be included in the regular raffling of criminal cases next week.
As the prosecution panel awaits the issuance of the arrest warrant, Senior Supt. Patrocinio Comendador urged Santos to keep her promise not to go into hiding.
The Cebu Provincial Police Office director, who is also the spokesperson of the Task Force Ellah Joy, told reporters yesterday that Santos should face the case in court.
Last March 30, the task force charged the couple with allegedly abducting the young girl outside her school in Calajoan, Minglanilla in the afternoon of Feb. 8.
Pique’s body was found at the bottom of a cliff near Sayaw Beach in Barili town the next day.
“I challenge her to be true to her word that she would not leave, that she would face the case,” Comendador said.
Santos repeatedly denied in previous interviews the rumor that she plans to escape and evade arrest, which surfaced after she reportedly sold her house. She said the house was up for sale since last year yet because she needed money.

But despite Santos’ assurance that she is ready to face trial, the police still have
doubts.
“For us, (the sale was) a preparation to hide from the clutches of the law… It is an indication that she is about to escape,” Commendador added.
The police director said they received reports that Santos is now living in Moalboal town, in southwest Cebu. He said they will continue to monitor her movement.
Bella’s older sister Anna Marion Lalican said that Santos is living with their mother in Inayagan.
Last week, the Office of the Cebu Provincial Prosecutor junked the motion for reconsideration the suspects’ lawyers filed, finding cause to hold the respondents for trial.
“The arguments set forth in the instant joint verified motion contain no new and substantial matters which would merit a resolution of their resolution,” the three-member investigating panel said.
The defense lawyers sought the reversal of the investigating prosecutors’ resolution and argued that the charge “failed to establish even a spark of probable cause.”
The prosecutors affirmed their resolution.
