Nepotism charge legally infirm – City Legal Officer
ANGELES CITY – City Legal Officer Reymon Fabros dismissed the nepotism charges of tabloid stringer Robledo Sanchez against Mayor Edgardo Pamintuan as “legally infirm.”
Sanchez pointed out to 15 individuals employed at city hall as job order workers whose surnames are Pamintuan.
According to Fabros, job order employees, according to the Civil Service Commission (CSC), are not considered government employees. There is no employee-employer relationship involving them.
“Even on the issue of nepotism, the charge is defective. According to the Local Government Code, nepotism in local government applies only to fourth civil degree of consanguinity and affinity,” Atty. Fabros said.
“Pamintuan is a common surname in Pampanga, as David, Santos, Dizon, Castro and even Sanchez, among others. I don’t think anyone of the 15 names whose surnames are Pamintuan falls within the coverage of the provisions of law,” he added.
The charge was based on a complaint filed by Sanchez before the Ombudsman against Pamintuan for alleged irregularities on the hiring of job order employees, a common practice among national and local government agencies.
Fabros had earlier branded the case as a “dud” because it cited as basis regulations of the CSC which were repealed in 2006.
Meanwhile, William Aguilar, deputy secretary general of the Partido Abe Kapampangan, said the Lazatin camp is obviously already running out of issues. “Lazatin is trying to sap a tree that is long dead,” he said.
He said the case is defective at the very beginning, “but it seems they are milking it for its propaganda value.”
“Quite simply, Lazatin is getting desperate by the day,” Aguilar said
