NEA dismisses disqualification case vs Cordova

THE Committee on Electoral Protest of the National Electrification Administration (NEA) dismissed the appeal for disqualification filed by former Edward Gasambelo against Roy Cordova for lack of merit.
Gasambelo was former president of Central Negros Electric Cooperative (Ceneco) while Cordova is newly elected Ceneco board member representing the District IV.
The resolution dated June 17, 2011 was signed by NEA Deputy Administrator Edgardo Piamonte and Director Milagros Quinajon of the Institutional Development Department while NEA Legal Services Office director Omar Mayo issued a dissenting opinion on the decision.
Gasambelo elevated the appeal to the Committee on Electoral Protest of NEA after the District Election Committee (Decom) ruled that it has no jurisdiction to address and resolve the Motion for Reconsideration filed by Gasambelo.
Gasambelo filed for disqualification against Cordova, stating that Cordova is ineligible to run for the position of member of the Board of Directors of Ceneco because he is not a bona fide member of the cooperative.
He stated that Cordova was an employee of Ceneco until February 1, 2011 when he severed his employment relations with the cooperative.
Thus, as of January 30, 2011, Cordova was still an employee of Ceneco. As an employee of Ceneco, Cordova was a member of the Responsible Supervisory and Confidential Union of Employees (Rescue) upon his promotion as head of the Meter Reading Section on Janaury 1, 2006 and had remained a member until February 1, 2011 when he severed his employment relations with Ceneco.
Gasambelo pointed out in his motion that a member of the Union of Ceneco cannot be a member of the said cooperative.
“It is crystal clear that the District Election Committee (Decom) exercises jurisdiction only on post election matters, which may be in the form of protest, queries, referrals or postponements which may or may not refer to election irregularities or qualification issues. By itself, post election matters are necessarily issues or concerns which
are raised to the attention of the DECOM after the proclamation of the results of the election,” the committee cites.
The issues raised in the motion for reconsideration dated April 26, 2011 filed by Gasambelo, having been raised before the conduct of the election and before the proclamation of the results of the election, cannot be considered as post election matter. Thus, the Decom does not have jurisdiction to address and resolve the same.
Cordova said that with the dismissal of the appeal, he can now go on serving the people of District IV.
He also urged Gasambelo to let go of the past, move on and work hand in hand for the sake of Ceneco consumers.
On the first Ceneco Board meeting set July 12, Cordova declared that he will propose resolutions to amend the EPIRA law and for Ceneco to uphold transparency in the conduct of business and board meetings and allow the media practitioners and member of the Social Action Center (SAC) to observe board meetings and other important activities.
