Mayor: Cityhood ruling a bad precedent

ANGELES CITY — Mayor Edgardo Pamintuan expressed dismay over the Supreme Court (SC) ruling that favors the conversion of 16 municipalities into cities.
“We are deeply saddened by what happened. This is a bad precedent,” said Pamintuan.
The SC decision is sending a message that an “entry of judgment” can now be opened, the mayor said.
Pamintuan said he is worried that this move will result into a decrease in the internal revenue allotment (IRA) share of Angeles in favor of the new cities.
“Because of the SC decision, some of our programmed projects this year would be jeopardized, as our share of the Internal Revenue Allotment (IRA) would be significantly reduced,” Pamintuan said.
The mayor said he will actively participate in the plans of the League of Cities of the Philippines (LCP) like the filing of another motion for reconsideration for the high tribunal to reverse its decision.
Pamintuan is currently the public relations officer of the LCP.
For the third time, the High Court voting en banc has reversed its decision annulling the city status of 16 municipalities and upholding the constitutionality of the laws converting them into cities.
The 16 municipalities that the SC recognized as cities were Baybay in Leyte; Bogo in Cebu; Catbalogan in Samar; Tandag in Surigao del Sur; Borongan in Eastern Samar; Tayabas in Quezon; Lamitan in Basilan; Tabuk in Kalinga; Bayugan in Agusan del Sur; Batac in Ilocos Norte; Mati in Davao Oriental; Guihulngan in Negros Oriental; Cabadbaran in Agusan del Norte; Carcar in Cebu; El Salvador in Misamis Oriental; and Naga in Cebu.
The LCP opposed the creation of new cities because these municipalities are not qualified on the basis of land area, population and annual income as mandated by the Local Government Code.
The City Council here is set to pass a resolution calling on the SC to stop the illegal conversion of municipalities to cities, protect the Local Government Code, uphold the rule of law and respect the constitution.
The said resolution states that “the flip-flopping of the SC is unprecedented in its history and will set a bad precedent and will disturb the well-established legal principles on finality and immutability of final judgments.” (Reynaldo G. Navales)
