Limlingan: A Special Court

JUSTICE delayed is justice denied, so goes the time-honored legal adage, which is used until now by some. Last Tuesday, fourth district Board Member Nestor “Bay” Tolentino has proposed for the creation of a specific court that will handle drug-related cases in the province.
The proposal aims to expedite a great number of complaints filed before our courts that involve drugs, and it seems that litigation on the same are going at a snail’s pace.
Apparently, hundreds of these cases are clogging our detention cells all throughout Pampanga, the reason why this active legislator is seeking the Supreme Court’s intervention that will speed up the legal process for law offenders on illegal drugs.
A visit to the Pampanga Provincial Jail would reveal that there’s a lot of statistics on drug cases. Drug-related cases don’t choose the gender of inmates. The count of female offenders would sometimes outnumber the males, while in a race to conviction or dismissal of their cases.
The race to promulgation is slowed down due to the increasing number of drug traffickers, pushers and users. They are not necessarily Kapampangans, but one thing is for sure: the fact that they congest our jails. Jail congestion leads to poor condition of our inmates.
Take the case of the growing number of vehicles plying our streets everyday vis-à-vis the number of roads being constructed. Regularly, there are drug offenders who are apprehended, jailed and charged in court. Their number is increasing, but not our jail facilities and jail personnel. It seems that illegal drugs have caught up a lot of law violators.
The poor condition of our jailbirds makes them suffer more aside from their freedom being suspended. In our country, most of our jails are cramped and putrid. The smell of sweat makes us think that they are poorly ventilated and poorly maintained. Not all of our jail facilities have sinners inside. There are those who are really innocent but wrongfully accused and charged.
I remember one time a law subject professor who once said that it is better to dismiss the case of a guilty man rather than convict an innocent. Not all inmates are guilty of the crime they are charged of.
Sad to note however, they languish in jail despite their innocence.
Tolentino’s legislation, if enacted would likewise benefit the jailed innocents as the hearing of their cases would speed up. Denying them the time to have their liberty is denying them justice.
Delaying their cases is denying the justice they deserve.
While congestion is an added penalty for our inmates, it is an added burden too for the government. The latter has to provide for the daily sustenance of inmates including their medication when in an ailment.
I have visited the Iwahig Penitentiary in Palawan just recently. It’s a different environment for inmates who are there, as they are given their chances to earn while serving sentence. The detention facility may be older than the oldest inmate, but it is well-kept and maintained.
Jailbirds at the said facility have the opportunity to engage in cottage industries such as making handicrafts and souvenir items. They are given their share for the products they manufacture.
The Iwahig Penal Colony is more than a penitentiary or a correctional facility, I find it more as a cottage industry facility, an income generator and a help to the local economy of Palawan.
Speaking of jails, the Cebu Provincial Detention and Rehabilitation Center is more than a jail facility. It has become an entertainment site for its dancing inmates. It has instantly gained fame and became a tourist spot aside from the fine sand beaches of the province. The dancing inmates have become dancing sensations on the internet and are renowned worldwide.
There are simple innovations that we can introduce for those who are in jails. The best of them however, is finding some legal ways to give them back their freedom the soonest.
