Ligots may face ‘evasion of arrest’ charge

FRESH charges of evasion of arrest may be filed against former military comptroller Jacinto Ligot and his wife Erlinda if it is proven that they went into hiding when a court issued their arrest warrants in September.
Justice Secretary Leila de Lima said Wednesday that persons who gave the Ligots refuge may also be held liable for obstruction of justice.
She said the Ligot couple may have gone into hiding when the Court of Tax Appeals (CTA) issued their arrest warrants after finding probable cause that they attempted to escape tax payments for 2003.
With this, de Lima said she instructed the National Bureau of Investigation (NBI) to submit a report detailing the couple’s whereabouts after the arrest warrants were issued.
“I will await the report from the NBI before determining any such liability for evading arrest. It (the filing of evasion charges) would depend on such facts or circumstances as knowledge of existence of arrest warrant and intention to evade,” she said.
The Justice department also formally filed a request before the CTA to issue a hold-departure order against the Ligots to ensure that they will not be able to leave the country, citing their supposed propensity to evade charges.
The couple was earlier reported missing after authorities failed to serve their arrest warrants since they were no longer in their address.
Court officers had said they also have no record of the Ligots’ lawyers, and have not received any pleading from the couple.
On Wednesday, the Ligots finally surfaced at the CTA and posted a bail of P150,000 for their temporary liberty. They are being held for multiple counts of violation of Section 254 of the National Internal Revenue Code, or attempt to defeat payment of taxes for the year 2003. (JCV/Sunnex)
