Mental tests for justices mandatory

WEEKS after The Manila Times broke the story about a woman justice who seemed to be “unstable,” the powerful Judicial and Bar Council (JBC) headed by Supreme Court Chief Justice Renato Corona required psychiatric and psychological tests for all applicants to the Supreme Court.
The requirements applied to incumbent justices from the Court of Appeals, Sandiganbayan and Court of Tax Appeals and judges who seek promotion.
During recent deliberations, JBC decided to make the aspirants undergo psychiatric tests in order to prevent appointment of mentally unfit judges and justices.
The woman justice, who was alleged to snap for no reason at all, made herself a big issue in the judiciary after The Times reported that she shouted on top of her voice while pounding the table inside a discussion room for 15 minutes.
She also was alleged to have gone berserk in front of her colleagues after she failed to respond intelligently to their questions.
It was learned that after The Times story was published, the woman justice stopped behaving abnormally, according to a court insider.
The insider believed that the justice was suffering from “bipolar disorder.”
Bipolar means “having or marked by two mutually repellant forces or two diametrically opposed natures, qualities or views.”
A proposal for judges and justices to be administered psychiatric tests was made after The Times interviewed Regino Hermosisima, a retired associate justice of the Supreme Court and now a member of the JBC, who said that psychiatric and psychological tests must be given to sitting judges and justices.
Hermosisima is considered as the “grand old man of the JBC” for having served there for three terms and possessing excellent credentials starting as a judge and then as a justice of the anti-graft court Sandiganbayan and Supreme Court associate justice.
Manifest insanity
Applicants for posts in the Supreme Court, Sandiganbayan and Court of Appeals used to be administered psychiatric and psychological tests.
Upon promotion, however, they were not tested again.
Hermosisima said that problems set in “when the insanity (of the judges and justices) will be manifested after getting the promotion or position in the judiciary and that is the end of it.”
During deliberations on May 2, 2011, JBC cited the case of a former Malabon Regional Trial Court (RTC) judge who believed in dwarfs, his “gabay” or guide.
He was removed from the service, fined P40,000 and disqualified to apply as Supreme Court justice under JBC rules.
The case of the RTC judge prompted JBC to make psychiatric and psychological tests for applicants to the judiciary mandatory.
Meanwhile, the Judicial and Bar Council is scheduled to vote today on a shortlist of nominees to be transmitted to President Benigno Aquino 3rd for two vacancies in the High Tribunal.
Twenty-eight applicants are in the running for the seats vacated by Associate Justices Antonio Eduardo Nachura, who retired on June 13, and Conchita Carpio-Morales on June 19.
The council is set to also vote for a shortlist for Deputy Ombudsman for Luzon.
The position became vacant in view of the resignation of Mark Jalandoni and Ombudsman Merceditas Gutierrez earlier.
Chief Justice Corona sits as JBC chairman with Justice Secretary Leila de Lima, Sen. Francis Escudero and Rep. Niel Tupas Jr. of Iloilo as ex-oficio members.
