Inclusion of funeral parlors under Anti-Hospital Detention Law sought

A PAMPANGA lawmaker has filed a bill to extend a law penalizing the detention of patients in hospitals for unpaid bills to include morgues and funeral parlors that refuse to release cadavers to families who cannot pay burial expenses.
Under a bill filed by Pampanga Representative Carmelo Lazatin, the Anti-Hospital Detention Act will include funeral parlors and will make illegal detention of patients and human remains punishable by imprisonment.
Under the law, “patients who have fully or partially recovered and who already wish to leave the hospital or medical clinic but are financially incapable to settle, in part or in full, their hospitalization expenses, including professional fees and medicines, shall be allowed to leave the hospital or medical clinic.” In exchange, patients are made to sign promissory notes secured by mortgage or by a co-maker.
“But many of these patients are ordinary employees or indigents who cannot afford to give a promissory note, in many instances, they are not allowed to leave the hospitals while the body of a dead person is detained by medical institutions or morgues,” Lazatin said.
Lazatin said some funeral parlors and morgues have also refused to release remains until families pay for burial services.
If Lazatin’s bill is passed into law, hospitals, morgues, and funeral parlors that refuse to release the remains face two years of imprisonment and a fine of P200,000.
Under the current law, illegal detention by hospitals only carries a fine of P20,000 to P50,000.
The bill also directs the Government Service Insurance System, Social Security System, Philippine Health Insurance Corp., and the Department of Social Welfare and Development to come up with programs to help indigents pay off hospital and funeral bills.
“If the patient is a member of the SSS, GSIS, or PhilHealth, a promissory note from either of the agencies would suffice. In the case of an indigent patient, a certification or guarantee from the DSWD (should be) sufficient,” Lazatin said. (Jonathan de Santos/Sunnex)
