Higher pay for workers on October 31, November 1, 7

EMPLOYEES of private companies will enjoy additional pay when they punch in for work on October 31, November 1 (All Saints’ Day), and November 7 (Eidul Adha or Feast of Sacrifice).
This was the reminder issued by the Department of Labor and Employment (Dole), adding that holiday pay rules and rates should be applied on those dates.
October 31 was declared as a special nationwide holiday under Proclamation No. 265, series of 2011, November 1 was declared special non-working day by virtue of Proclamation No. 84, and November 7 was declared as regular holiday under Proclamation No. 276, Dole Secretary Rosalinda Baldoz said.
As a result, employees working on October 31 and November 1 are entitled to 130 percent of their daily rate for the first eight hours and up to an additional 30 percent of his hourly rate on the said day for work performed in excess of eight hours, the Dole said.
If unworked, employees are not entitled to any payment, unless a favorable company policy, practice, or collective bargaining agreement (CBA) allow for payment even if unworked.
Meanwhile, if any of these two days fall under employees’ days off, they are entitled to receive 150 percent of their daily rates if they work on these days. For work performed in excess of eight hours, they are also entitled to an additional 30 percent of their hourly rate on the said day.
Workers who punch in on November 7 are entitled to 200 percent of their basic wage on the first eight hours and, for work in excess of the eight hours, to an additional 30 percent of their hourly rate on the said day. If unworked, employees are entitled to 100 percent of the regular daily rate as long as they were present or were on leave with pay on the workday immediately preceding the holiday.
If the day is the workers’ day off, they are entitled to 260 percent of his or her daily rate on the first eight hours, plus 30 percent for work in excess of eight hours on the said day. If unworked, employees are entitled only to 100 percent of their regular rate, provided they are present, or were on leave with pay, on the workday immediately preceding the holiday.
In case the day immediately preceding the holiday is a non-work day in the establishment, or is the scheduled dayoff of employees, they will not be deemed on leave of absence on that day, in which case they will be entitled to the regular holiday pay. (FP/Sunnex)
