Ex-village chair wants Tarzan probed too

ANGELES CITY– A former barangay chairman in this city has formally asked the Commission on Audit (COA) to conduct an investigation against First District Representative Carmelo “Tarzan” Lazatin for alleged violation of laws against graft and corruption.
In his complaint-letter addressed to COA Chairperson Ma. Gracia Pulido-Tan, and copy furnished Regional Head Asst. Commissioner Winnie Rose Encalado and City Resident Auditor Rowena Bucu, former Barangay Sto. Cristo Chairman Aymer Alvarado alleged that Lazatin violated certain laws by appropriating funds from his Priority Development Assistance Fund to benefit the Republic Central Colleges, particularly Sec. 3 of Republic act 3190 or the Anti-Graft and Corrupt Practices Act and Sections 7 and 7a of RA 6713 or the Code of Conduct and Ethical Standards for Public Officials and Employees.
According to Alvarado, Lazatin is a member of the Board of Trustees and an officer of the college.
He pointed specifically to the scholarship program wherein hundreds of thousands of pesos from the 78-year old congressman’s PDAF were said to be granted directly to RCC.
“While the scholarship program is a noble project, the manner in which the funds were allocated was against the law,” he said.
A perusal of the documents Alvarado submitted to COA indicated that the amount Php200,000 was allocated in the 2012 PDAF of Lazatin for RCC.
“I filed the complaint against Lazatin because I believe he violated certain laws against graft and corruption. Simply put, he could not give funds from his PDAF to the RCC which everyone in Angeles City knows is owned by the family of Lazatin. It is even chaired by Lazatin’s sister, Dr. Victoria L. Angeles. The congressman is also an officer of the said college,” Alvarado explained.
“Nagsasabi siya na gagawing niyang 100% na libre ang pag-aaral sa City College of Angeles kapag siya ay nahalal na punong-lungsod pero ang kakatwa ay kahit isang sentimo ay wala siyang binigay na pondo mula sa kanyang PDAF para sa City College. Nagbigay pa siya ng pondo sa isang kolehiyo na kanilang pagmamay-ari. Kahit hindi po ako abogado, sa tingin ko ay ito ay labag sa batas at isang malinaw na conflict of interest,” Alvarado added.
Section 3 of Republic Act 3190 or the Anti-Graft and Corrupt Practices Act prohibited government officials from committing certain acts including the following: Entering, on behalf of the Government, into any contract or transaction manifestly and grossly disadvantageous to the same, whether or not the public officer profited or will profit thereby; directly or indirectly having financing or pecuniary interest in any business, contract or transaction in connection with which he intervenes or takes part in his official capacity, or in which he is prohibited by the Constitution or by any law from having any interest; and, directly or indirectly becoming interested, for personal gain, or having a material interest in any transaction or act requiring the approval of a board, panel or group of which he is a member, and which exercises discretion in such approval, even if he votes against the same or does not participate in the action of the board, committee, panel or group.
Republic Act 6713 or the Code of Conduct and Ethical Standards for Public Officials and Employees defined conflict of interest as “when a public official or employee is a member of the board, an officer, or a substantial stockholder of a private corporation or owner or has a substantial interest in a business, and the interest of such corporation or business, or his rights or duties therein, may be opposed to or affected by the faithful performance of official duty.”
Section 7 and 7 (a) of the same law stated that: In addition to acts and omissions of public officials and employees now prescribed in the Constitution and existing laws, the following shall constitute prohibited acts and transactions of any public official and employee and are hereby declared to be unlawful: (a) Financial and material interest. — Public officials and employees shall not, directly or indirectly, have any financial or material interest in any transaction requiring the approval of their office.
