Electoral sabotage case vs Arroyo rendered travel approval moot

MANILA — The planned departure of former President Gloria Macapagal-Arroyo is now in the hands of the Pasay Regional Trial Court (RTC) after the Commission on Elections filed electoral sabotage charges against her, two party-list lawmakers said.
According to Bayan Muna Representatives Teddy Casiño and Neri Colmenares, the filing of the charges has mooted the issue of the temporary restraining order (TRO) issued by the Supreme Court (SC).
In a vote of 8-5, High Court justices junked the government’s appeal on the TRO issued on the watchlist order against the former First Couple. The SC said the former President, and her husband, Jose Miguel can leave the country.
However, the Department of Justice refused to implement it and filed an appeal which the High Tribunal junked on Friday.
Meanwhile, despite speculations that the Commission on Elections (Comelec) railroaded the filing of charges against the Arroyos, Colmenares, a lawyer, defended the poll body saying the case filed has been investigated too exhaustively.
On Friday morning, the Comelec 5-2 to charge Arroyo, but not her husband, lawyer Jose Miguel. That case was raffled off to Pasay City Court branch 112 that afternoon.
“We hope the proper case will result today in the detention of the accused or at the very least a denial of an allow departure order by the court. The people waited for years to hold GMA to account, they will not allow GMA to escape this time without a fight,” said Casiño.
In a separate report, Senator Francis Pangilinan expressed the same sentiments, saying that the TRO that allowed Arroyo to travel has lost its basis.
“The Comelec decision should serve as solid basis for the Supreme Court to recall its restraining order against the Aquino government,” Pangilinan said, adding the premise for the issuance of the TRO no longer hold water.
He said the Supreme Court should withdraw the TRO, which it can do at any time.
For his part, Senator Franklin Drilon, a former justice secretary, said that “it is accepted and unwritten that once a case is filed, and the Regional Trial Court (issues a) warrant of arrest, the court will now have full jurisdiction and can issue the hold departure order, which will make the case in the Supreme Court academic,” he said.
