DOJ, Ombudsman urged to file court case vs Arroyo

A CRITIC of former President Gloria Macapagal-Arroyo said that Justice Secretary Leila de Lima should immediately file a case in court if she wants to prevent the former President from leaving the country.
Bayan Muna Representative Teddy Casino said de Lima and Ombudsman Conchita Carpio-Morales should already take action on the numerous charges filed against Arroyo so that they can secure a hold departure order against her.
“They should now throw the book at Arroyo. Some of these complaints have been languishing with our prosecutors for a year. It shouldn’t be so hard for government prosecutors to establish probable cause, file charges, and immediately get a hold (departure) order,” the party-list lawmaker said in a text message.
Casino has filed two plunder cases against the former President before the Office of the Ombudsman. The first, filed in July, is for Arroyo’s alleged misuse of Philippine Charity Sweepstakes Office funds. The second, filed in September, is for the botched national broadband network deal with China’s ZTE Corp.
Four other plunder cases have been filed against the former President, three of which have been lodged at the Department of Justice (DOJ).
On Thursday, De Lima again deferred her decision on the allow departure order (ADO) request filed by the former President, a document which she is required to secure after being placed on the immigration watchlist.
Arroyo, along with former First Gentleman Jose Miguel Arroyo, and 41 others have been placed on the watchlist after being implicated in the electoral sabotage charges filed by Senator Aquilino Pimentel III.
Arroyo wants to leave the country to seek medical treatment for her bone mineral disorder.
The camp of Arroyo said they are considering questioning the watchlist order before the Supreme Court (SC) since Department Circular 41, which was used by De Lima to issue the watchlist order, infringes upon an individual’s constitutional right to travel.
“The Aquino administration is bound to have another legal defeat in SC on Arroyo WLO because by insisting on using a mere DOJ watchlist to prevent Arroyo from going abroad, Malacañang is violating a constitutional right,” Casino said.
“The Aquino administration is risking another slap in the face once the former President brings her case to the Supreme Court. We are against Arroyo from leaving but are worried that she can legally get away with it,” he added.
Meanwhile, House Minority Leader Edcel Lagman also insisted that Arroyo’s request for an allow departure order is not only a question of compassion or health condition but a matter of the constitutional right to travel without any impediment.
“Former President Arroyo’s travel does not involve national security, public safety, or public health, which are the only constitutional limitations to a citizen’s right to travel which shall be provided by law,” he said.
Lagman has earlier filed House Bill 5111 wherein the proper court will have exclusive jurisdiction to issue a hold departure program or allow departure order. The applicant of the hold departure order can be the complainant, the Bureau of Immigration, and the DOJ.
