Customs files smuggling case vs oil firm

AN OIL firm with a terminal in Misamis Oriental was charged with smuggling.
Filed at the Department of Justice, the case claimed that Jetti Petroleum Inc. — the sixth petroleum company to face such charges from the Bureau of Customs (BOC) — owed P4.1 billion to the government after it supposedly imported oil products without paying the appropriate taxes to the government.
Among those named in the case were Jetti president Joselito Tobayan Magalona, broker lawyer Darwin Suico, Cagayan de Oro-based broker Dario Amolata and several John and Jane Does.
From June 2010 to June 2011, Jetti imported oil from Singapore but failed to submit import entries for oil products it brought in within the required 30-day period, Customs Commissioner Angelito Alvarez said.
Of the 49 import entries unloaded at the sub-port of Mindanao International Terminal in the company’s Tagaloan, Misamis Oriental facility, 45 entries were discovered to be tainted, Customs officials said.
Some P1.1 billion worth of petroleum products imported by Jetti between September 28, 2010 and May 16, 2011 cleared customs even if the import entries for the said shipments failed to meet the 30-day deadline, Alvarez said.
Some P2.9 billion worth of imported petroleum products covered by 30 import entry declarations cleared customs despite the importer’s failure to submit the required Load Port Survey (LPS) and/or Discharge Port Survey (DPS) forms.
“Again, existing regulations require that said shipments should have been considered high-risk and should have remained in customs custody until accomplishment and submission of the DPS and other applicable control measures,” he said.
Jetti also failed to pay P11.7 million in duties and taxes for its various importations as it paid only P896.4 million instead of remitting P908.2 million to the BOC.
The company “could not have succeeded in pulling off this caper without the connivance and indispensable cooperation of corrupt customs officials and employees,” Customs Commissioner Angelito Alvarez said.
Jetti is the sixth oil company to be charged with smuggling by the BOC after it filed similar cases against Pilipinas Shell, Phoenix Petroleum, Cross Country, Oil Link, and Filpride.
