Court officer downplays Ampatuan’s threat of admin case

A COURT officer hearing the infamous Maguindanao massacre trial downplayed the possibility that suspect Zaldy Ampatuan may file an administrative complaint against Judge Jocelyn Solis-Reyes.
This came after Ampatuan’s lawyer Firdausi Abbas said Friday that the court has become “inhuman” when it ordered the release of the dismissed Autonomous Region in Muslim Mindanao (Armm) governor from the hospital.
Ampatuan stayed at the Philippine Heart Center for two days after reportedly showing signs of heart failure.
“He (Abbas) has all the liberty to file an administrative case against (Quezon City Regional Trial Court Branch 221) Judge Reyes at the Supreme Court. The court only subscribed to the medical abstract and other documents regarding Zaldy’s condition, hence, the decision not to extend his confinement anymore,” the court officer, who spoke on condition of anonymity, told Sun.Star.
Results of an angiogram conducted by the hospital early Friday on Ampatuan showed that the governor has “insignificant coronary artery disease,” according to his attending physician Dr. Danilo Kuizon.
This means that Ampatuan can continue medication even at his detention cell in Camp Bagong Diwa, Taguig City, where twice-a-week hearings are being conducted since December last year.
Families of slain victims led by Maguindanao Governor Esmael “Toto” Mangudadatu have since opposed the court’s move to grant Ampatuan a medical check-up outside the jail’s premises.
“Essentially, the court gave Zaldy’s camp a favor despite opposition from the families of victims of the massacre. I think he should be even thankful that the court allowed his client to undergo medical tests,” the source said.
Private prosecutor Harry Roque shared the source’s sentiments in a text message, saying: “Let them file everything! (The) truth will set us free!”
Last year, Sigfrid Fortun, counsel for prime suspect Andal Ampatuan Jr., repeatedly asked Reyes to inhibit herself from the case, citing her alleged partiality against the accused.
Reyes, however, junked all four petitions for her to stop hearing the case.
“She is certainly not infallible, but she stands pat on the correctness of the rulings she made during the bail hearings. Thus it is her humble opinion that no valid cause exists for the Presiding Judge to inhibit,” Reyes said in an August 2010 order.
