Council ready to address flea market issue

CANDABA — A top official here has expressed readiness to address the flea market controversy in Barangay Bahay Pare once a complaint or clarification has been filed before the Municipal Council.
Vice Mayor Daniel Gallardo said the Municipal Council here is willing to assume jurisdiction over the issue, whether the barangay has the authority to collect taxes and fees from the tiangge peddlers.
The council is also willing to determine if the flea market conforms to the municipality’s existing revised revenue code, he added.
Gallardo clarified that under the Local Government Code, barangay officials can exact fees or rentals from certain businesses using barangay facilities.
However, he said the collection should be supported by a barangay tax ordinance duly confirmed by the Municipal Council to avoid double taxation.
The vice mayor said that under the Local Government Code, the council has the disciplining power over the barangay officials.
Gallardo, however, admitted that the council on its own cannot investigate and dig deeper into the issue of collection in the absence of a formal complaint filed before them.
Gallardo said that on the issuance of business permit, the mayor has the ministerial duty to approve or disapprove a permit if it does not submit the requirements needed.
The mayor can refuse granting permits if it is not deemed beneficial for the city’s greater interest, which is peace and order. He or she also has the sole authority to implement national and municipal laws for the interest of the general public such as restriction on road obstruction, traffic congestion and order with the assistance of local police, he added.
