Case set vs recruiter of Filipina drug mule

THE recruiter of a Filipina who was executed for bringing drugs to China will soon have a case lodged against her.
This developed after the Department of Justice (DOJ) recommended charges against Tita Cacayan, the alleged recruiter of Sally Ordinario-Villanueva, who was executed in China.

Senior Assistant State Prosecutor Lilian Doris Alejo has found probable cause to file a drug-trafficking and a large-scale illegal recruitment case against Cacayan.
In her six-page resolution, Cacayan could be held liable of large-scale illegal recruitment as prohibited in the Migrant Workers Act of 1995 (Republic Act 8042).
“In as much as respondent Cacayan procured/referred/promised overseas employment to the aforementioned complainants, despite the fact that she is not licensed to do so, and purchased plane tickets for them, there is probable cause to hold her liable for violation of Section 6 of RA 9042 as amended,” said the resolution.
Since there are more than three complainants against her, the ruling said it can now be considered as large scale illegal recruitment.
The resolution gave weight to the testimony of Melita Comedes, owner and manager of Winluck Travel and Tours, where Cacayan supposedly bought the tickets for Villanueva and her other alleged recruits.
Cacayan allegedly gave Villanueva a $500 pocket money and the suitcase she used in her trip, Comedes said.
In the meantime, drug trafficking charges were based on the testimony of a male complainant who said Cacayan gave him 43 capsules of A-class cocaine.
The act violates Republic Act 9165 or the Dangerous Drugs Act of 2002.
“The act of respondent Cacayan in giving 43 capsules containing A-class cocaine, a dangerous drug, to complainant for the latter to swallow and later transport out of the country, constitutes violation of Section 5 of RA 9165,” said the resolution.
Ordinario-Villanueva was executed via lethal injection in China last March 30 after she was convicted of attempting to smuggle 4,110 grams of heroin into Xiamen back in December 24, 2008.
Ordinario-Villanueva denied any knowledge of the act to smuggle drugs into China, saying she was only misled by Cacayan. (AMN/Sunnex)
