Carpio: Impeachment trial did not wound judiciary
MANILA (Updated, 1:50 p.m.) — Senior Associate Justice Antonio Carpio dismissed an observation of a junior colleague that the impeachment trial resulted in a “wounded” judiciary, saying the process brought to light the problems hounding the institution such as clogged dockets and corruption.
In response to a statement on Wednesday by Associate Justice Roberto Abad, Carpio said the impeachment pushed the Court to work on the problems as much as possible. Abad is also vying for the position of Chief Justice.
Carpio simply reiterated what he shared last June 29 to members of the Integrated Bar of the Philippines (IBP) in Angeles City on his thoughts about fixing the system.
The magistrate said the judiciary’s number one problem is clogged dockets, which is a result of delays in trial and deciding cases.
Trials should not normally take over two years to finish, the 1987 Constitution states, but Supreme Court records revealed that 21 percent of cases take two to five years to end and 13 percent were only resolved after five years.
To solve this, Carpio proposed the adoption of a computerized case management system (CMS) from first level courts to the Supreme Court.
The CMS, he said, will allow the Chief Justice, presiding justices, the court administrator and the deputy court administrators to monitor real-time the caseload, aging, and the rate of disposition of cases of any judge or justice.
He also proposed a simplified trial procedure for all trial courts, where prosecutors must attach the affidavit of witnesses before the information is filed.
He made the statement after noting that 80 percent of pending cases are criminal cases, of which 40 percent are drug cases where the prosecution always asks for postponement.
Like other candidates, Carpio is pushing for a higher budget for the judiciary by calling on President Benigno Aquino III to convene the Judicial Executive Legislative Advisory and Consultative Council (Jelac) to discuss budgetary requirements.
If possible, Carpio wanted the construction of more courthouses in a span of 10 to 15 years in order to plug shortages and replace dilapidated ones.
Outsider will demoralize Court
In implementing reforms, the senior justice admitted that a member of the High Court should be the one to lead them in the next few years.
“I will not deny that it will be bad for the morale (of the insiders),” he said, noting that seniority tradition has been followed in all major courts like the Court of Appeals and Sandiganbayan.
But in the end, he said he will respect the decision of the President as to who should be chosen as the next Chief Justice.
Meantime, Carpio denied accusations that he lobbied with the justices to join him in controversial cases, saying he never visited them on their chambers.
The magistrate was earlier accused of pushing for the acquittal of Hubert Webb despite having inhibited in the deliberations for the case because he once testified in favor of Webb when he was still the chief presidential legal counsel of former President Fidel Ramos. Webb was eventually freed in December 2010.
Thumbing down rumors that he joined the ouster plot against Corona, Carpio told Iloilo Representative Niel Tupas Jr. that would be impossible since he never talked to him or urged the rest of the 187 congressmen who signed the impeachment complaint.
“I was accused as one of those who schemed with President Aquino and (Transportation) Secretary Mar Roxas but I never talked to those people. In fact they are saying I will never be appointed (as Chief Justice) because I am not close to the President,” he told the JBC.
Corona was convicted by the Senate impeachment court last May 29 for failing to disclose some P180 million worth of peso and dollar deposits in his statement of assets, liabilities and net worth (SALN).
“If I misdeclared my SALN that way, I would’ve resigned,” Carpio said.
Carpio, however, is open to reconciliation with Corona. “Yes, why not? You can always forgive and forget,” he said.
