Boutique faces P227-M tax evasion raps
SOME P226.9 million worth of tax evasion cases were filed before the Department of Justice against owners of boutiques and a pet shop that issued fake receipts, the Bureau of Internal Revenue (BIR) said Thursday.
In a report, the BIR found Globe Mallow International Enterprises Corp. (GMIEC), which runs the Genevieve Gozum boutiques, to have been bloating its expenses, claiming false input value added tax (VAT), thus underdeclaring its income and VAT.
GMIEC was claiming to have bought P223.42 million from Fine & Fancy Fabrics Center, which the latter denied.
The value added tax system allows the agency to track purchases between buyers and their suppliers and the system flagged the discrepancy in the submissions of the two.
Fine & Fancy Fabrics Center denied having any business dealings with the boutique owner and asked it to rectify its claims with the BIR. The clothing company also supposedly failed to respond to the BIR when asked to explain the discrepancy.
GMIEC is being sued for a total tax deficiency amounting to P226.99 million, including surcharges and interest, for taxable years 2006, 2007, and 2010, broken down as P166.30 million in income tax and P60.69 million in VAT.
Set to face charges are Genoveva Gozum and Gene Gozum for allegedly violating sections 254 and 255 of the National Internal Revenue Code or for evading taxes and failing to supply the BIR with correct and accurate information.
The penalty for violating section 254 of the tax code is a fine of P30,000 to P100,000 and imprisonment of two to four years, while the violation of section 255 carries a fine of at least P10,000 and imprisonment of one to 10 years.
Based in Cubao, Quezon City, GMIEC is in the business of producing, fabricating, buying, selling, distributing, and marketing all kinds of goods, commodities, wares and merchandise.
It has different branches in various malls in Metro Manila and a store in North Reclamation Area, Cebu City.
Meanwhile, the BIR wants Joycee Ann Jona Gapasin de Josep, owner of Bloomers Petshop and Clinic, charged for printing official receipts and/or commercial invoices without authority from the BIR. Gapasin is also accused of failing to issue duly-registered receipts.
In a visit last November 18, the BIR officer who posed as customer discovered that the pet shop based in Harrison Plaza, Manila, has been issuing supposed official receipts that have the same serial numbers.
