Arroyo: Spain has extradition treaty with Philippines

THE camp of former President Gloria Macapagal-Arroyo assailed Justice Secretary Leila de Lima for giving sweeping arguments in her decision to deny the incumbent Pampanga lawmaker the right to seek medical treatment abroad.
For one, Arroyo’s counsels said Spain, one of the countries listed by Arroyo in her travel itinerary, has an extradition treaty with the Philippines.
“Aside from the fact that the Philippines has a signed Extradition Treaty with Spain, dated 2 March 2004, and a signed Mutual Legal Assistance in Criminal Matters Treaty with Spain, also dated 2 March 2004, the Philippines has a Transfer of Sentenced Persons Agreement with Spain,” an excerpt of the 44-page supplemental petition filed with the Supreme Court said.
Inconsistencies with regard to Arroyo’s final travel itinerary was one of the basis cited by de Lima in a report last November 8 as the government feared that the former leader might skip prosecution from high crimes if she will stay in countries with no extradition treaty.
Besides Spain, Arroyo also expressed interest to travel to Germany and Singapore.
But the petition shrugged off such claim since the Philippine government can still ensure that “criminals are prosecuted and crimes are punished” even in areas with no extradition treaty.
“To begin with, there is no allegation, moreso proof, that Singapore, Germany and Spain are countries which harbor fugitives from justice or that they will reject a request by the Philippine government to deport and bring back absconding criminal offenders,” the petition read.
Also, the petition said passports of so-called fugitives may be cancelled by the Department of Foreign Affairs and will be used as basis for the deportation of “undocumented criminals.”
Meanwhile, the Arroyo camp maintained that there were no discrepancies in the medical abstracts that its client submitted to the justice department.
“Without any factual basis, the respondent DOJ Secretary was too quick to impute petitioner GMA (has) an intent to abscond from the Philippine criminal justice system,” the petition stated.
Arroyo and her husband Jose Miguel, who are facing electoral sabotage and plunder cases, earlier asked the High Court to nullify the watchlist orders against them because it supposedly curtailed their constitutional right to travel.
The court might decide on the issue on its en banc session on Tuesday even as Justice Bienvenido Reyes, one of the reported two justices-in-charge of the petitions, has yet to give his recommendation to Chief Justice Renato Corona. (Virgil Lopez/Sunnex)
