Aquino delaying signing of bill for Armm poll postponement

PRESIDENT Benigno Aquino III is deliberately stalling the signing of the enrolled bill postponing the August 2011 elections in the Autonomous Region of Muslin Mindanao (Armm), House Minority Leader Edcel Lagman said.
The “obvious motive for this dilatory scheme” is to deny the Supreme Court (SC) enough time to rule on expected petitions questioning the proposed law’s validity, which, in turn, will also allow President Aquino to appoint officers-in-charge in the autonomous region, the opposition lawmaker said.

“As long as the enrolled bill remains unsigned by the President, any petition before the Supreme Court will be premature in the absence of a covering statute,” Lagman noted.

“Meanwhile, time is running out and any petition could be rendered moot and academic as the preparation for the scheduled elections appears to have been halted by the Commission on Elections (Comelec) as if the postponement is already a done deal,” he added.
The House minority bloc earlier vowed that it will question the measure seeking the synchronization of the Armm elections with the 2013 midterm elections once it is signed into law.
House Bill 4146 was approved by Congress last June 7 after the House of Representatives concurred with the amendments adopted by the Senate in its separate version, Senate Bill 2756.
From June 7, it took the Congress 10 days to enroll the bill with Speaker Feliciano Belmonte Jr. and Senate President Juan Ponce Enrile and the respective Secretaries of the two chambers signing the printed copy of the bill.

Since then, the enrolled bill has been with the Office of the President and has remained unsigned by President Aquino.
“After getting what he wanted from the Congress, the President is temporizing in signing the bill into law to prevent the Supreme Court from resolving what he does not want, which is the nullification of the deferment of the Armm elections and his appointment of OICs,” Lagman stressed.
For his part, Presidential Development and Strategic Planning Secretary Ricky Carandang turned the tables and blamed Congress for the delay.
The bill has yet to reach the President’s table, he said.
“We’re waiting for the right time when Congress forwarded the bill to us,” he said.
He noted that the President is in fact looking forward to signing the bill, which is one of the priority bills of the Aquino administration.
“We want to give much attention to the Armm. We set separate time for the Armm to explain to them to importance of the postponement,” he added.
He also said that much opinions have been said about the postponement but the Palace will stand by its position that reforms will only be implemented in Armm if the August 8 elections will be postponed.
“We respect the opinion of other people who don’t agree with the postponement. At the same time, Congress already passed the bill so let’s just support the measure and the efforts of the government,” the Palace official said. (Kathrina Alvarez/Jill Beltran/Sunnex)
