DND on cases of 4 officers in Al Barka massacre: ‘Not sure yet’

MANILA, Philippines – The Department of National Defense (DND) is not sure how it will proceed with the cases of four senior Army officers, who are facing a military court trial for charges in connection with the ambush-slaying of 19 soldiers by the Moro Islamic Liberation Front (MILF) rebels in Al-Barka Basilan on October 18, 2011.

β€œLet’s see. I am not sure yet. We will consult. I don’t have details yet. But everybody wants a closure to these cases and we move forward,” DND spokesperson Peter Paul Galvez said in an interview on Tuesday.

Galvez was reacting to questions from the media on the current status of the four senior Army officers’ cases and other high-profile cases that stemmed from the MILF’s hostilities in Mindanao now that the government has signed the “Framework Agreement on the Bangsamoro” with the Moro rebels.

The framework agreement paves the way for the signing of a final peace agreement between the government and the MILF. It also lays the grounds for the setting up of a new Bangsamoro political entity that would replace the Autonomous Region in Muslim Mindanao (ARMM).

Former Special Forces Regimental Commander Col. Amikandra Undog, ex-Basilan island military commander Col. Alexander Macario, 4th Special Forces Battalion commander Lt. Col. Leonardo Pena, and Lt. Col. Orlando Edralin, former Special Forces training school commander are facing charges before a military court for the carnage of the 19 soldiers.

The four officers are facing charges for violation of Article of War 97 or conduct prejudicial to good order and military discipline in conjunction with criminal negligence under Article 365 in the Revised Penal Code.

The filing of charges against the four military officers was a result of an investigation conducted by the military as ordered by President Benigno Aquino III last year.

The defense and the prosecution have finished the presentation of evidence.

The mlilitary courty has set the oral arguments for the case of the four officers on Thursday, October 18 or exactly a year after the carnage.

Exactly one year on Thursday, a day-long fighting broke out between government troops and the MILF rebels, reportedly reinforced by the Abu Sayyaf Group, in Barangay Cambog, Al Barka town leaving 19 young Special Forces and Scout Rangers killed.

The troops were in the area for a hit-and-run operation against the Abu Sayyaf Group, but their presence were compromised triggering an early morning to dusk fighting.

The MILF had insisted that the soldiers entered their group’s controlled area. It said that coordination should be made before government troops can enter an MILF area to avoid a misencounter.

Following the carnage, President Aquino ordered an investigation with an instruction to the military leadership to file the necessary charges if warranted against Army officers behind the botched anti-terror and anti-kidnapping military operations.

The presidential directive resulted to the relief and later the filing of charges against the four Army officers.

The four, submitted themselves under the jurisdiction of the military court, with an appeal for a speedy trial as they maintained that the Al Barka carnage was a legitimate military operation, which was bungled when MILF rebels ambushed the troops.

With the framework agreement already signed, the accused officers again reiterated their appeal for a speedy trial of their case.
