Sandiganbayan undecided yet on Arroyo hospital arrest
The Sandiganbayan on Thursday set another hearing for next week to tackle the bid of former President Gloria Macapagal-Arroyo to remain under hospital arrest at the Veterans Memorial Medical Center (VMMC) in Quezon City.
After it heard the arguments of lawyers of the prosecution and defense on Mrs. Arroyo’s urgent motion for hospital arrest, the anti-graft court set another hearing at 1:30 p.m. of October 18, radio dzBB’s Allan Gatus reported.
It said this will allow the prosecution to submit its comments on the motion.
Associate Justice Efren N. dela Cruz, chairman of the Sandiganbayan First Division, said doctors attending to the former president will be summoned “to substantiate” her claim that she is unfit to be transferred to a regular holding cell.
During the oral argument, prosecution lawyers said there was no more reason for Mrs. Arroyo to stay at the VMMC since she was already well.
Instead, Arroyo should be moved to the holding facilities of the National Bureau of Investigation or the PNP Detention Center in Camp Crame, lead prosecutor Diosdado Calonge told the court.
“If she needs physical therapy, that can be done there,” he said.
They also argued that Mrs. Arroyo’s plan to seek re-election as Pampanga congresswoman belies her claim she is ill.
But defense lawyers argued Arroyo still needs to undergo physical therapy at the VMMC, adding a medical discharge does not necessarily mean she is already well. They maintained that Mrs. Arroyo is seeking re-election because she wanted to help her constituents.
At Thursday’s hearing, lead defense counsel Anacleto Diaz stressed that the former President still require “extensive physical therapy sessions” and hospital arrest would be the most logical arrangement to enable her to get immediate medical attention if and when her conditions requires it.
He argued that the purpose of placing a defendant under arrest, which is to ensure that her movement is curtailed and that she remains under court jurisdiction has already been carried out since she is effectively detained.
“There’s no need to be vindictive about this. After all she was a former President…like former Presidents Estrada and Ramos. She is inescapably, a national symbol,” Diaz said.
Meanwhile, a separate report by dzBB’s Glen Juego said Mrs. Arroyo’s supporters gathered outside the Sandiganbayan to call for her release.
The supporters sang “Gloria, Gloria walang sala (Gloria, Gloria is innocent)” to the tune of “Gloria, Gloria Labandera.”
Mrs. Arroyo has been under hospital arrest at the VMMC since last Thursday, when police served on her an arrest warrant issued by the graft court for plunder.
The plunder charges were in connection with alleged irregularities at the Philippine Charity Sweepstakes Office.
In July, a Pasig court allowed Mrs. Arroyo to post bail in connection with the electoral charges filed against her in December last year. — RSJ/HS/KBK, GMA News
