Aquino ratifies labor convention for domestic workers
PRESIDENT Benigno Aquino III has ratified the International Labor Organization’s (ILO) Convention 189 concerning decent work for domestic workers and forwarded it to the Senate for its concurrence.
Department of Labor and Employment (Dole) Secretary Rosalinda Baldoz said the country’s ratification of the landmark convention definitely sends a strong signal to the world of the Philippine government’s firm commitment to the welfare and protection of domestic workers.
“President Aquino has ratified ILO Convention 189 on 18 May and has sent to the Senate, through Senate President Juan Ponce Enrile, the Instrument of Ratification for its concurrence,” Baldoz said. “We welcome this development and we hope the Senate will concur in its ratification.”
She said the convention and its accompanying recommendations, which apply all domestic workers, set the standards for decent work for domestic workers and provide them with the same protection, respect, and dignity accorded to other workers.
The ratification of ILO Convention 189 makes the Philippines the second ILO member state, following the earlier ratification made by Uruguay, of the landmark convention that the Philippines, through the Dole, had played a leading role toward its adoption by the 183-member ILO during the 100th session of the International Labour Conference in Geneva, Switzerland on June 16 last year.
The Philippine ratification would complete the required two ILO member states to put the Convention into force. Article 21 of the Convention provides that it shall come into force 12 months after the date on which the ratification of two members has been registered with the director-general of the International Labor Office. Thereafter, the Convention shall come into force for any member 12 months after the date on which is ratification is registered.
The anticipated completion of the Philippines’s process of ratification of ILO Convention 189 is expected to make it one of the fastest-ratified ILO Conventions in history, amplified all the more by its universal significance in emancipating the vulnerable domestic workers and in lifting them from virtual slavery and abuse-prone conditions, to decent work status at level with formal workers.
Aquino, in his letter to Enrile and the members of the Senate said “the Department of Labor and Employment and the Tripartite Industrial Peace Council (TIPC) were consulted and concurred with the ratification of the Convention.”
Under the Convention, each ILO member-state shall take measures set out in the Convention to ensure the effective promotion and protection of the human rights of all domestic workers and to respect, promote and realize the fundamental principles and rights at work of domestic workers, namely: freedom of association and the effective recognition of the right to collective bargaining; the elimination of all forms of forced or compulsory labor; the effective abolition of child labor; and elimination of discrimination in respect of employment and occupation.
Baldoz said the Philippines’ groundwork for the ratification of ILO Convention 189 was soundly based on a thorough and meticulous process of social dialogue and consultations with the tripartite sectors, advocates, and stakeholders.
