Aquino allies back up prosecution to get Corona’s SALN
SEVERAL senator-judges allied with the Aquino administration had to back up the prosecution panel before the Supreme Court (SC) Clerk of Court was ordered to surrender Chief Justice Renato Corona’s statements of assets, liabilities and net worth (SALN) Wednesday before the impeachment court.
Clerk of Court Enriquetta Vidal was the first witness presented by the prosecution panel in connection with Article II or Corona’s non-disclosure of his SALN records since he became a member of the Judiciary.
As clerk of court, Vidal’s office receives the SALNs, and subscriptions and signatures are done before her. One of her staff members, Verna Albano, is in charge of keeping it.
Through its lead private prosecutor, lawyer Mario Bautista, the prosecution panel asked Vidal to surrender the SALN records but Vidal, citing a court resolution dated May 2, 1989, refused.
“In view of resolution of court in May 2, 1989, I am restricted because it says here in one of the guidelines that all requests for statements of assets, liabilities and net worth will have to be filed with the clerk of court. It means it will only be filed with me,” Vidal said.
“It is not within my competence, it is within the competence of the court,” Vidal further explained as she asked that she be given more time to seek the authorization from the SC. She said her subpoena was included in the agenda and the request for the SALNs was to be discussed Tuesday next week during the SC en banc meeting.
In a SC press briefing, however, Court Administrator and SC spokesperson Jose Midas Marquez said that Vidal was authorized by Corona to release his SALN.
Senator Franklin Drilon, a member of the Liberal Party (LP), argued that it was proper that the SALN records which had already been subpoenad be surrendered by Vidal and make it part of the records.
Senator Francis “Kiko” Pangilinan, another LP member, insisted on the release of the SALN saying that the subpoena duces tecum was issued not to the Supreme Court but to the Clerk of Court.
“The subpoena is addressed to clerk of court and the documents are here. Vidal can tell SC she was compelled,” Senator Francis “Chiz” Escudero, also an ally of Aquino, added.
Senator Joker Arroyo, a perceived ally of former President Gloria Macapagal-Arroyo, meanwhile requested the Senate impeachment court to allow Vidal to authorize the release of SALNs with the SC first.
Arroyo warned a clash of courts – between the SC and the Senate impeachment court – after Enrile ordered Vidal to hand the documents over.
House Deputy Speaker Lorenzo “Erin” Tanada, spokesperson for the prosecution panel, admitted “there is a way of asking questions which makes it difficult for the prosecution to ask.”
“Remember, all that we are after here is the truth of the matter and it is up to the senators to search for the truth,” he said when asked if the prosecution panel would always rely on their allies in the Senate during the trial.
