Pasay court orders arrest of 3 accused of poll sabotage

A PASAY City court has issued arrest warrants against three persons accused of poll sabotage in North and South Cotabato in 2007, just a day after the complaint was filed by the Commission on Elections (Comelec).
However, the same court failed to place former Comelec chief Benjamin Abalos under arrest after he filed an urgent motion to determine probable cause.
The Pasay City Regional Trial Court (RTC) branch 112 issued arrest warrants against former South Cotabato provincial election supervisor Lilian Suan-Radam, former North Cotabato provincial election supervisor Yogie Martirizar, and Captain Peter Reyes of the Intelligence Service of the Armed Forces of the Philippines (ISAFP).
The arrest warrants were issued past 3 p.m. Thursday by Judge Jesus Mupas, the same judge who placed former president and now Pampanga Representative Gloria Macapagal-Arroyo under arrest for the same charge.
Abalos, who escaped arrest by filing the appeal, has repeatedly denied involvement in the alleged irregularities in the 2007 mid-term elections. He instead blamed Radam and Martirizar, who, in turn, accused Abalos of directly instructing them to favor senatorial bets of the Arroyo administration.
Both Radam and Martirizar said in April 2007, Abalos met them personally in Davao City and instructed them to make Arroyo’s Team Unity candidates win 12-0.
Both former local election officials claimed that Abalos told them the instructions came from Malacanang, adding they were pressured into signing extra copies of certificate of canvass and statement of votes to alter the results of the mid-term polls.
Both have also signified readiness to testify against Abalos even though the Comelec rejected the finding of their joint panel with the Justice department to exclude them in the electoral sabotage case.
For his part, Comelec Chairman Sixto Brillantes refused to ask why the Pasay court failed to issue a warrant against Abalos.
“We filed the case at 4:30 p.m. so how can he (Mupas) issue an arrest warrant? Nobody would issue a warrant after 5 oโ€™clock. On the other hand, had he issued one by 4:45 pm or 4:50 pm, critics will say it took the judge less than 30 minutes to read the case,” Brillantes said.
Since the case has been filed, the poll body will be leaving the matter to the court.
“We will not intervene with that anymore since it is up to the discretion of the court. If the judge does not want to issue (a warrant) immediately, it is totally up to them. We cannot dictate on them,” the poll chief said.(AH/FPSunnex)
