Casiño: Palace killing information bill

MANILA — Bayan Muna Representative Teddy Casiño on Friday slammed Malacañang for “killing” the primary purpose of the freedom of information (FOI) bill listing 11 exceptions to the proposed legislation.
The party-list legislator said a draft formed by the Palace’s FOI study group listed the following exceptions to the long-delayed measure:
1) Information that may cause damage to national security or defense and its revelation may cause grave damage to national security or internal and external defense of the State,
2) Matters pertaining to foreign affairs, that its revelation shall/may unduly weaken the negotiating position of the government in an ongoing bilateral or multilateral negotiation or seriously jeopardize our diplomatic relations, and
3) Law enforcement and border control information when its disclosure would: unduly compromise or deal with any military operation or law enforcement operation.
4) Records of minutes and advice during decision making or policy formulation,
5) Drafts of orders, solutions, memoranda and the like,
6) Information in executive session in either House of Congress,
7) Trade secrets,
8) Personal information of a natural person,
9) Classified as privilege communications in legal proceedings by law or by Rules of Court,
10) It is exempted by law or Constitution, and
11) The information is already made accessible through other means.
“Malacañang is, in effect, condoning the withholding of information from the public…We hope that Malacañang would stick with our proposed bill and not water it down so that it will truly be a true Freedom of Information Law,” Casiño said in a press statement.
He said an FOI law would back up the recent accusations on alleged poll fraud committed in 2004 and 2007 elections if only such legislation has been passed in the past Congresses.
Election paraphernalia would readily be available with an FOI law but instead Malacañang “itself is making the proposed FOI toothless by placing so many exceptions to its coverage.”
Despite getting several advices from his allies in Congress on the FOI measure, President Benigno Aquino III decided to leave out the proposed bill in his second State of the Nation Address, which could have signaled his intention on the measure already. (Kathrina Alvarez/Sunnex)
