NBP officials face raps over Leviste caper

FIVE officials of National Bilibid Prisons (NBP) will face charges of misconduct, neglect of duty and conduct prejudicial to the best interest of the service over former Gov. Jose Antonio Leviste of Batangas getting out of the national penitentiary without proper authorization.
In a 36-page report, the Department of Justice (DOJ) on Wednesday recommended that the charges be filed against Fortunato Justo, Chief Supt. Armando Miranda, Chief Supt. Ramon Reyes, Dante Cruz and Robert Rabo.
The report said that Justo, the custodian of Leviste, committed gross neglect of duty when he failed to stop the former governor from making unauthorized exits from NBP in Muntinlupa City (Metro Manila).
It added that the custodian will also be criminally charged for infidelity in securing a prisoner.
The DOJ report said that Miranda, a former NBP superintendent, had a direct hand in giving VIP treatment to Leviste.
It added that he had transferred the former governor, 71, to the minimum security compound with “sleeping-out” privileges without any clear basis and exempted Leviste from the stipulated headcount requirement.
The report said that Reyes, current NBP superintendent, also failed to cancel the inmate’s status and privileges as a sleeping-out prisoner despite previous reports on Leviste’s earlier trips outside the penitentiary.
According to the DOJ report, Cruz, a former chief of the minimum security compound, approved headcount exemption for Leviste.
It said that Rabo, current chief of the minimum security compound, failed, too, to take appropriate and official action upon discovery that the former governor–a homicide convict—was violating prison rules and regulations.
Justice Secretray Leila de Lima said that she had obtained clearance from President Benigno Aquino 3rd to release contents of the report.
Bureau of Corrections Director Ernesto Diokno, who had been blamed for the Leviste caper, has been off the hook since resigning recently and supposedly planned criminal and administrative cases against him are now moot.
The DOJ report, however, found Diokno to have also failed taking appropriate official action on reports on Leviste getting in and out of NBP with apparent impunity.
Administrative proceedings against the corrections bureau’s former chief, a presidential appointee, may be initiated by the Office of the President, based on the findings of the Justice department, according to the report.
