Nepomuceno vs Pamintuan recount set May 16

ANGELES CITY — The poll body has ordered the start of the manual recount in connection with the election protest filed by former Angeles City mayor Francis Nepomuceno against incumbent Mayor Edgardo Pamintuan.
“The recount will be done manually and the ballots will be physically reviewed before comparing their results to the election returns produced by the Precinct Count Optical Scan (PCOS) machines,” Nepomuceno’s legal counsel lawyer Romeo Yusi Jr. said.
The recount will be held at the Electoral Contests Adjudication Department (Ecad), Commission on Elections (Comelec) office in Manila from 8:30 a.m. to 12 p.m. and from 1:30 p.m. to 5 p.m., Mondays to Fridays.
It shall continue thereafter until terminated, Yusi said.
He also said that four ballot boxes are expected to be at the recount area not later 8:15 a.m. for the morning session and another batch of four ballot boxes not later than 1:15 p.m. for the afternoon session.
“In the event there are anomalies and irregularities found in the course of the proceedings, the remaining 80 percent or 148 contested clustered precincts will be retrieved from the Angeles City Treasurerβs Office for manual recount and revisions,” Yusi said.
The Comelec, he added, has directed both parties to see to it that their respective revisors are punctual in attending the recount proceedings.
“Absence of any of the revisors shall not delay or postpone the said proceedings. Recount proceedings starts from the time that the ballot boxes are taken from the Comelec Philpost warehouse and delivered to the recount area at 8 a.m.,” he said.
Pamintuan’s revisors have until 8:30 a.m. or a 30-minute grace period to arrive at the designated place of recount, while Nepomuceno’s revisors have until 9 a.m. or one hour grace period to arrive at the recount area.
The recount committees are composed of four groups, said Yusi.
He said the First Recount Committee is chaired by lawyer Magellan Ferrer (overall supervisor), while the Second Recount Committee is chaired by lawyer Roseller Abad.
The Third Recount Committee, he added, is chaired by lawyer Daisy Real with the Fourth Committee being chaired by Director Betty Pizana and Director Allen Francis Abaya.
“Each committee has alternate chairmen, recorders and ballot box custodians,” Yusi said.
The recount committee chairmen are also directed to submit daily recount reports at the Clerk of the Second Division immediately after every proceeding, Yusi said.
According to him, Nepomuceno — as the protestant — was directed by the Comelec to pinpoint 20 percent or 37 priority clustered precincts of the total 185 contested clustered precincts.
Nepomuceno sought a recount in the ballot boxes in 185 clustered precincts of the total 916 established precincts.
