Ex-mayor’s camp claims ‘errors’ in compact flash cards

ANGELES CITY — The camp of former Mayor Francis Nepomuceno on Thursday claimed that there were “errors” recorded during the duplication of compact flash cards (CFCs) during the last elections.
According to Nepomucenoโs legal counsel, Romeo Yusi Jr., the said CFCs are placed in a ballot box bearing serial number CE-07-111837. It has one outer seal and steel wire with serial number 0003607, with one outer Comelec metal seal with serial number CE-09-08031 and two outer Comelec padlocks, he added.
The said ballot box, Yusi said, was transferred by Comelec-Angeles City on June 17, 2010 to the Comelec provincial office in the City of San Fernando.
He said it took eight months before it was deposited to the security vault of the Election Records and Statistics Department (ERSD) at Comelec main office in Manila last February 28, 2011.
โHowever, prior its transfer to the ERSD the ballot box had no padlocks, only plastic straws and a metal seal,โ Yusi said.
Yusi also said that out of the 185 clustered precincts, only 166 main CFCs were contained in the ballot box, while 31 are only back-up CFCs, which do not contain ballot images.
He added that only 163 CFCs were transmitted while five CFCs were not transmitted by the Precinct Count Optical Scan (PCOS) machines, particularly in clustered precincts 56 (126, 144, 90, 113, 96, 125 – Cutcut), 57 (177A, 178A, 179A, 180A, 180B – Cutcut), 139 (451A, 452A, 452B – Pulung Maragul), 131 (432A, 432B, 433A, 434A, 435A – Pulung Maragul), 138 (449A, 449B, 450A, 450B – Pulung Maragul).
โMost of the CFCs are individually enveloped, but they are open and torn when they are supposed to be sealed. Some CFCs have no envelopes and are just wrapped in bond papers, while some envelopes do not contain CFCs, only election returns,โ Yusi said.
He also said that the creation of back-up files by the Smartmatic technical personnel last May 6, 2011 revealed errors, thereby raising some questions.
Earlier, the Comelec ordered for a manual recount in connection with the poll protest filed by Nepomuceno against incumbent Mayor Edgardo Pamintuan in the May 10, 2010 mayoral elections.
Pamintuan, for his part, said he is willing to face Nepomuceno and his camp “in any forum.”
