Lawyer faces estafa charges
April 18, 2011
TARLAC CITY β A man has filed estafa charges against a lawyer based in Pangasinan for failing to present documents of a piece of land he was selling.
Antonio Aguinaldo, 57, a native of Paniqui town, filed the estafa charges against Lawyer Isaiah Asuncion at the local court. Asuncion, 54, is a native of Binalonan, Pangasinan.
Police investigation showed that Aguinaldo gave the lawyer P100,000 as down payment for a 4.4-hectare land after agreements pertinent to its sale were made.
The land located at Moncada, Tarlac, being sold for P1.98 million was allegedly owned by the lawyerβs mother Patria.
On November, Asuncion asked for an additional P400,000 down payment for the land but failed to show the buyer the land documents.
The lack of land documents made Aguinaldo refuse to pay the additional down payment.
Aguinaldo even tried to contact the sales agent of the land to state his willingness to buy the property, only if they could show him land documents. However, there was no response from the sales agent.
On December, Aguinaldo demanded the lawyer to return his money but the latter refused.
February this year, Aguinaldo sent a demand letter to Asuncion to return his money. The latter still did not return the victimβs money, which prompted Aguinaldo to file estafa charges.
Pertinent documents are still being prepared for filing in court.
