Businessman files reply affidavit on libel suit vs newsmen

CITY OF SAN FERNANDO — Businessman Rene Romero on Monday filed his reply affidavit in connection with the P20-million libel suit against four staff of a local newspaper.
The move is in response to the counter-affidavits filed by respondents Caesar “Bong” Lacson, Joselilto “Joey” Aguilar, general manager Gener “Bong” Endona, and marketing manager Joanna Niña “Ning” Cordero last March 13.
Lacson earlier said his counter-affidavit was basically grounded on the “procedural and contextual.” He said his article about Romero appeared as a letter to the editor on December 14 in Sun.Star Pampanga, three days before the same column was published in Punto.
“If indeed, Romero found cause for libel in the article as published in Punto!, it is of great surprise to me that he did not initiate a similar action against Sun.Star Pampanga where the same article likewise titled “Romero ululating” appeared…even at an earlier date,” Lacson said in his counter-affidavit.
“This is a case of selective prosecution,” he added.
Lacson, likewise, cited Romero’s reaction to his article in Sun.Star as published by the paper on December 15, wherein he was reported to have been “amused” by the article.
Romero, however, in his reply affidavit, said his action does not constitute selective persecution, adding that Lacson is responsible for the letter he sent to Sun.Star Pampanga.
“Lacson is obviously testing the waters when he sent a copy of his libelous article as letter to the editor to Sun.Star Pampanga. He was also trying to sow enmity between me and Sun.Star Pampanga – one of Pampanga’s most decent newspapers,” Romero said in his reply affidavit.
It could be remembered that Lacson also maintained that his article constituted “fair comment, and thus is not libelous,” citing that it was a “rejoinder” to an earlier news item in Sun.Star wherein Romero assailed the failure of the 2010 Most Outstanding Kapampangan Award (MOKA) judges to choose a winner in the business sector.
Lacson was a member of the five-man MOKA board of judges. Romero was one of the three nominees for the business category.
However, Romero said that Lacson’s choice of words in his column were “malicious and designed to sow intrigue and ridicule him” in public.
“The starting four-letter word “ulul” either in Kapampangan or Tagalog is an invective, a cuss word meaning “crazy”. Connecting this with the last two syllables “lating” is the verb ululating,” Romero said.
Romero also countered on other issues raised by the group in their counter-affidavits. The respondents are expected to submit their reply this coming May
