High Court likely to debate Corona petition

THE Supreme Court (SC) may moot the petition of Chief Justice Renato Corona to stop the Senate impeachment court from probing his bank deposits in view of the magistrate’s unconditional waiver over his bank accounts. The Senate, sitting as an impeachment court, is expected to take a vote today, Tuesday, on whether or not to convict Corona on three remaining articles of impeachment. Corona in his petition also asked the SC to eventually declare null and void the impeachment complaint filed by 188 members of the House of Representatives having been filed without any basis. The Corona petition is separate from the petition filed by PS Bank seeking the same reliefs from the Court, and which landed in the division of Associate Justice Estela Perlas-Bernabe, an appointee of President Benigno Aquino III. The SC later on granted PSBank’s petition for the issuance of a temporary restraining order. Meanwhile, the Integrated Bar of the Philippines (IBP) said it should be up to the High Court to make a determination or interpret the spirit of Republic Act 6426 (foreign currency deposits law), and not the Senate.IBP spokesman Dennis Habawel said in a statement that there is “no hard and fast rule” in deciding whether Corona’s interpretation of the confidentiality clause in the FDC law is correct or not.”Since the SC has not decided any case involving the applicability of the secrecy of foreign currency bank deposits to the SALN (statement of assets, liabilities and net worth), there is no hard and fast rule by which to say whether or not the interpretation given by the CJ is correct. In the light of the CJ’s un-rebutted claim that in a BIR (Bureau of Internal Revenue) study, no public official has ever declared foreign currency deposits in any SALN, it would seem that the compliance officers of other agencies of government share the CJ’s interpretation that dollar deposits need not be disclosed in the SALN by any public officer,” said Habawel.”At the very least, it is the basis for good faith not only of the CJ and the other compliance officers but of all public officers relying on such interpretation,” the IBP official said.
