Pe bares plan to move south

CEBU City Councilor Augustus Pe Jr. yesterday confirmed talks he will resign from his post as north district councilor next year so he can run for a City Council seat in the south district in 2013.
Pe, a third-term councilor, intends to transfer his voter’s registration records from Barangay Capitol Site in the north district to Barangay Guadalupe in the south so he can qualify to run for south district councilor.

Meanwhile, Rep. Tomas Osmeña (Cebu City, south district) disclosed yesterday that he will still be active in politics in 2013.
But he said he might only campaign for his bet.
Osmeña said his candidate for mayor might be either Vice Mayor Joy Augustus Young or his wife Margot, a councilor.
Resign
In an interview yesterday, Pe said he will resign from his post early next year, a year before the May 2013 elections, to comply with election rules and to give him time to familiarize himself with individual concerns of the south district barangays.
The Commission on Elections (Comelec) requires those running for office to be a resident of the locality where he or she intends to run for at least one year. They should also be a registered voter of the said locality.
Election laws also prohibit an official from running for the same position after three consecutive terms.
If he pushes through with it, Cebu City’s poll officials said Pe’s move may raise legal questions that only the court can decide on, since his is a “unique” case.
Lawyer Edwin Cadungog, city election officer for the south district, said Pe’s candidacy in the south will be a test case.

Legal question
Citing the Local Government Code and the Omnibus Election Code, he said “the voluntary resignation from office should not be considered an interruption of the continuity of service for which he was elected.”
“There may also a legal question on his candidacy in another district that’s in the same city or local government unit. Whether or not that is allowed, it’s for the court to decide because there has been no precedent to this. It will be a test case,” he told Sun.Star Cebu.
Pe, 50, said he wants to run for councilor to contribute to the City’s efforts in developing the south district, especially the mountain barangays, which he said lacks infrastructure and road networks.
“I have been around the south district and in terms of development, daghan pa kaayog kuwang sa south so perhaps I can contribute in identifying and addressing their needs.
For example, daghan pang south barangays na walay sports complex and road concreting
projects,” he said in an interview yesterday.
An important project that the south district needs, he said, is the bridge that will go to Barangay Buot Taup and a road network that will connect the different mountain barangays.
Greed
Pe, who was first elected as city councilor in 2004, said he wants to serve the people of the south district, even if some people will interpret his move as greed for power.
“If this is just greed, then I will run for a higher office, perhaps for mayor or congressman? Why then will I be running for councilor again?” he said.
Aside from helping implement infrastructure projects in the south, Pe also wants to help develop mountain villages into eco-tourism areas and improve the city’s agricultural sector.
He also wants to help address the problem on informal settlers in the urban barangays.
Pe, chairman of the council committee on public order and safety, said he wants to do for the south district what he has already done in the north, where he lay the groundwork for road projects and the construction of the Pulangbato-Pitos Bridge, Busay-Budlaan Bridge and Guba-Adlaon Bridge.

Prohibition
“Hopefully, in these aspects, makatabang ko… Naa na man nahimo atong incumbent councilors for the road concreting in the south but since the roads are longer and the distance is farther, dili kaapas ba,”he added.
In a separate interview, lawyer Marchel Sarno, election officer for the north district, said that by resigning from his post, Pe will only be complying with the prohibition against elected officials serving beyond three consecutive terms.
He said Pe’s candidacy in another district but in the same city that he last served might be questioned.
“This is a unique case. Although maputol iyang service and dili na three consecutive terms, he will run in another district that’s in the same city. It will have to be referred to the law department of Comelec or to the court, if a disqualification case will be filed,” said Sarno.
