Fresh batch of ‘certified’ countries due April

THE Philippine Overseas Employment Administration (POEA) said it expects the next batch of “certified” countries to be released on April next year.
POEA Administrator Carlos Cao said the agency is set to come out with a new resolution on “compliant” countries within the six-month extension period given by Congress to the POEA.
“The POEA resolution for 31 receiving countries with qualified compliance based on DFA (Department of Foreign Affairs) certifications is due by April 2012,” said Cao.
He said this would allow officials from the Philippines and receiving countries to come up with bilateral agreements required for overseas Filipino workers (OFWs) protection.
“During this time, period bilateral agreements for OFW protection will be negotiated by the Philippine government with host countries,” said Cao.
To note, the POEA had certified compliant a total of 125 countries, wherein OFW deployment have been endorsed.
On the other hand, 41 countries have already been imposed with deployment bans for being “non-compliant” to the requirements provided under the Migrant Workers Act.
The DFA has, however, sought for the deferment of the deployment ban saying it needs more time to dialogue with the concerned countries.
Over the weekend, Cao related that the POEA Governing Board is set to continuously deliberate on the request of the DFA.
“POEA Governing Board Resolution No. 7 does not take effect until after 15 days and we will take advantage of it. We believe it will give us ample time to discuss the matter thoroughly and extensively on whether to defer or not,” said the labor official.
“Finality of the terms, thereof, cannot be pre-empted at this point,” Cao added.
The POEA resolution is originally set to take effect on November 18, or 15 days after their publication in two newspapers of general circulation.
In a related development, the recruitment industry called on the DFA to simply withdraw and review the non-compliant certification to the POEA.
In a statement, recruitment consultant Lito Soriano opined that in doing so, it would give the POEA the ample reason to temporarily defer the implementation of the ban just like the DFA has requested.
“Withdrawal will give the POEA the legal reason to temporarily withhold the implementation of the deployment ban,” said Soriano.
To note, Republic Act 10022 provides that the POEA can be held liable if it continues to send OFWs to countries that have been non-compliant to provisions of the law. (AMN/Sunnex)
