Aquino’s cousin rejects ombudsman post

MANILA — Defeated presidential candidate Gilbert Teodoro on Thursday thumbed down the suggestion of Senator Miriam Defensor-Santiago for him to take the place of outgoing Ombudsman Merceditas Gutierrez.

Teodoro said he was grateful for Santiago’s trust in him and he was humbled and grateful for the kind words the senator had said to him, but said his present endeavors “do not allow me to consider returning to government service at this time.”

“However, I continue to do my share for my country in a private capacity, as every citizen should,” he added.

Santiago on Wednesday expressed confidence that Teodoro could keep the Office of Ombudsman independent, saying his integrity is “beyond question.”

Gutierrez, who had faced impeachment trial by the Senate, tendered her resignation on April 29 and is officially stepping down from the post on May 6.

Teodoro lost to his cousin, President Benigno Aquino III, in the May 10, 2010 presidential elections.

Before he was nominated standard bearer by the Lakas-Kampi-Christian Muslim Democrats, Teodoro served as defense secretary under the Arroyo administration.

He was also a former member of the House of Representatives, representing Tarlac province from 1998 to 2007.

Malacañang, meanwhile, sees legal obstacles in the appointment of Teodoro being the President’s second-degree cousin.

Deputy presidential spokesperson Abigail Valte said there are prohibitions on the appointments that have to be considered.

The President has been strict in observing the constitutional prohibition about nepotism, she said.

The Constitution also bars Teodoro from being appointed ombudsman. The Constitution states: “The ombudsman and his deputies… at the time of their appointment must not have been candidates for any elective office in the immediately preceding election.”

The constitutional prohibition was seconded by House justice committee chairman Niel Tupas Jr. and other congressmen.

“Gibo might be disqualified because under the Constitution, the ombudsman must not have been a candidate for any elective office in the immediately preceding election,” he said in a text message.

Nevertheless, Teodoro said he and his family is grateful for Santiago’s continued trust in him, particularly when she vouched for his integrity and competence.

The Judicial and Bar Council, which will screen nominees to the post that Gutierrez will leave on Friday, has yet to declare the position vacant.
