CITY OF SAN FERNANDO — The legal battle between former governor Eddie Panlilio, Provincial Administrator Vivian Dabu and the sacked Biyaya A Luluguran at Sisikapan (Balas) boys continues to draw fire, as the parties refused to budge after Monday’s hearing where an “amicable settlement” remains elusive.
The 43 former quarrymen were hailed to court in 2008 by Panlilio and Dabu for libel, grave slander and oral defamation, alarms and scandals, and unjust vexation docketed under criminal case 16949 at the Regional Trial Court Branch 46 in the sala of Judge Mary Ann Pardo de Rivera.
During the hearing on Monday where Panlilio and Dabu personally appeared, the Balas boys said they were taken aback when the former priest-governor “scolded” them for their actions during their 256-day protest at Arnedo Park.
“He berated us for our actions. Hindi na lang kami kumibo,” the group said, adding it will not apologize nor issue any statement admitting its members’ guilt.
“It could be a trap,” the Balas boys said.
In Panlilio’s complaint, he said the protesters did not dwell on the issues that may have led them to stage such a rally and call for Dabu’s resignation.
He said: “They (protesters) focused on maligning my personality and reputation, aimed to demoralize me and eventually, to succumb and resign to their pleasure of making her resign…In my decision to maintain Attorney Dabu in her position as provincial administrator, the rallyists have resorted to defaming me as well to pressure me to accede to their clamor for Attorney Dabu’s resignation; they are now likewise calling for my resignation.”
The quarrymen have since stood their ground versus Panlilio and Dabu’s allegations, pleading “not guilty” of the charges. Their legal counsel, third district Board Member Rolly Macalino, was able to work out for the reduction of their bail, from P20,000 to P10,000 each.
Macalino also said then that with the new system in the judiciary, mediation was a way for the settlement of the case. The Balas boys, who were for a while re-employed at Capitol, however, said they foresee a long battle ahead after Monday’s hearing.
Among the 43, only Archie Reyes so far has been cleared by the court after a re-investigation early this year.
