Lilia Pineda and former Gov. Eddie Panlilio both admit that their third battle for the highest local elective post in Pampanga this year will not be a walk in the park.
“As a Catholic, I have high respect for members of the clergy. Among Ed (Panlilio) was a priest and I know that he also wants to serve the Kapampangan. And I am not certain if the Kapampangan want me back to the capitol. It will be up to them to decide,” Pineda says.
Pineda, 62, has been in politics for 30 years now. She was mayor of Lubao town for three terms and also served as provincial board member.
Panlilio, a Catholic priest whose priestly faculties were suspended when he entered politics, defeated Pineda and then reelectionist Gov. Mark Lapid in the 2007 election.
He served as governor from 2007 to 2010. But three months before the 2010 elections, the Commission on Elections (Comelec) second division declared Pineda winner in the gubernatorial race after the revision of ballots showed that she obtained 190,729 votes against Panlilio’s 188,718.
The Comelec ordered Panlilio to vacate the governor’s office and allow Pineda to take over the capitol.
But Pineda did not assume the post. She said she had made her point—that she won in the 2007 gubernatorial election—and that forcibly ejecting Panlilio from the capitol could only result in violence and further division among the Kapampangan. In the 2010 election, Pineda won by a margin of some 246,000 votes.
In this year’s election, Pineda enjoys the support of all the reelectionist mayors of the 19 Pampanga towns and Mabalacat City, or their “chosen heirs,” under her local political party, the Kambilan. Most of the three-term local officials who seek other positions are running under Kambilan. Only the City of San Fernando, the capital city, has no Kambilan candidate.
Panlilio, on the other hand, admits that he has no support from local officials. But he is being supported by President Aquino and the Liberal Party.
“It is hard because Pineda is moneyed and she is being supported by almost all local officials. There are even several towns where those running against one another for mayor and vice mayor both support her. Examples are my hometown of Minalin, Sto. Tomas and Mabalacat, he says.
“But the other side of the coin is that the President is supporting me and he asked me to run for governor. So the situation now is different from that in 2010,” he adds.
Arroyo ally
Pineda is known to be an ally and close friend of former President Macapagal-Arroyo, who is running for reelection as representative of the province’s second district. Arroyo still enjoys the support of her cabalen (province mates), many of whom believe that she is innocent of the graft and plunder charges filed against her by the Aquino administration.
But for Pineda, her closeness to Arroyo is not a factor in her reelection bid. In the local level, she says it is not a question of alliance or closeness with national politicians.
“In local politics, that has no significance because you serve the people directly and they can see what you do. It has nothing to do with my closeness to former President Arroyo. She, as the former president and congresswoman of her district, implemented her own projects for her constituents. As for myself, I also implemented my own projects. What is important is whether the promises you made during the campaign have been realized or not,” she says.
‘Jueteng politics’
Panlilio says his campaign would center on educating the people about “jueteng politics,” referring to his rival’s husband, suspected jueteng financier Rodolfo “Bong” Pineda, who was once investigated by the Senate for his alleged involvement in the illegal numbers game.
“We will also educate the people about political dynasty-in-the-making. She (Pineda) is running tandem with her son (former Lubao Mayor Dennis Pineda), and this served as a bad precedent to others in the municipal level. In Bacolor, for instance, the mayor’s running mate is his mother. In Sto. Tomas, the husband is running for mayor and his wife for vice mayor,” he said.
Pineda said with her son by her side, she would better provide the services needed by the Kapampangan.

In the May elections, he is seeking another term.
Morales, who lost his first mayoral bid in 1992 to the late Mayor Catalino Domingo, became chief executive of Mabalacat in 1995 and was reelected in 1998, 2001, 2004, 2007 and 2010 elections.
Except for a six-month suspension in 1999 and a month-and-a-half of turning over his post to his vice mayor in 2007, Morales occupied the mayor’s office from July 1, 1995 until this day.
The Local Government Code of 1991 (Republic Act No. 7160) prohibits any person from occupying an elective office for more than three consecutive terms.
If this is the case, how did Morales hurdle the three-term limit rule set by the law?
Some residents said he has good lawyers, who included election lawyer Romulo Macalintal. Some said it was sheer luck.
Just like most elected officials, Morales perennially faced electoral protests filed by his political opponents and losing candidates. However, it was these cases that enabled him to become an eligible mayoral candidate every election for 17 years now.
Morales earlier said that it never crossed his mind that a successful electoral protest against him would pave the way for him to become a long-time mayor of Mabalacat.
Court intervention
Shortly after the 1998 elections, the late businessman Anthony Dee, who contested Morales’ reelection bid, sought the court’s intervention for the revision of the ballots.
On April 2, 2001, the Angeles City Regional Trial Court Branch 57 ruled that it was Dee who won the 1998 mayoral election. But due to a series of motions and counteractions, the court’s decision did not become final and executory until Aug. 6, 2001—barely three months after Morales won the 2001 mayoral contest and was already serving his third term as mayor.
Dee never had the chance to serve and perform his duties as mayor.
Morales filed his certificate of candidacy for the same post in the 2004 elections. His move resulted in the filing of disqualification cases against him by his political opponents before the Commission on Elections. They argued that he had already completed three consecutive terms—from 1995 to 2004.
‘Interruptions’
Morales cited the “interruptions” in his terms as grounds for his eligibility to seek another term, which included his suspension from Jan. 16 to June 15, 1999, due to a graft case that was eventually dismissed and the court’s proclamation of Dee’s victory in the 1998 elections.
On May 4, 2004, the Comelec’s second division ruled that Morales was disqualified to run for mayor in the May 10, 2004 elections and canceled his certificate of candidacy, saying he had served three consecutive terms and could no longer run for a fourth term.
After filing a motion for reconsideration, the Comelec en banc allowed Morales to run. He was reelected.
On March 14, 2005, while Morales was already serving as mayor for 10 consecutive years, the Comelec en banc reversed the second division’s resolution, saying Morales was eligible to run for mayor in the 2004 elections.
Had Morales’ rivals decided to accept the Comelec en banc’s resolution, the mayor would be eligible to run for reelection only until the 2007 elections, with his lawful term starting in 2001.
But the disqualification case against Morales was elevated to the Supreme Court, which issued decisions that eventually allowed him to run for reelection until 2013.
On May 9, 2007, the high court reversed the 2005 Comelec en banc’s decision and canceled Morales’ certificate of candidacy for the 2004 elections after ruling that he was not eligible to have run in the 2004 elections because he was a fourth-term candidate.
The high court ordered him to vacate his post to then Vice Mayor Prospero Lagman, who acted as mayor for a month and 14 days, from May 16 to June 30, 2007.
The high court’s ruling, which declared that “Morales cannot be considered a candidate in the May 2004 elections,” made him eligible to run for reelection in the 2010 elections and seek a third term in the May 13, 2013 elections.
The separate electoral case seeking to disqualify Morales from running for reelection in 2007, “for fully serving three terms from 1998 to 2007” with only a very short period of interruption, was junked by the Comelec second division on July 27, 2007 and by the Comelec en banc on Feb. 14, 2008.
The Comelec said he “was considered not a candidate in the 2004 synchronized national and local elections.” “Hence, his failure to qualify for the 2004 elections is a gap and allows him to run again for the same position in the May 14, 2007 national and local elections,” the poll body said. Guiao said his platform priorities include the conversion of the Clark Development Corporation (CDC) into an “authority;” the granting of benefits like retirement pay for barangay captains and councilmen; and uniting the whole district through reforms and change.
The first district includes the cities of Angeles and Mabalacat, and the town of Magalang.
“We need to have Clark converted into an authority already as this mean more investments, jobs and progress not only for the First District but for the whole of Central Luzon. It is our best asset,” he told Grace Hamon, host of “Boto Mo, Kinabukasan Mo” candidates forum on Tuesday.
Guiao said this includes pushing for the twinning of Clark International Airport and the Ninoy Aquino International Airport as the ultimate dream and plan.
“We have met with other top officials including the private sector on this. Saksi si Mayor Oca [Rodriguez], Mr. Levy Laus ng PamCham at si Manny V. Pangilinan sa nagging pag-uusap tungkol sa SCTEx-NLEx connection and the needed fast train which will the two airports. It is a congressman’s job to legislate this at tayo naman ay patuloy na mangungulit sa taas,” he said.
The three-term vice governor and former board member added even in his tenure, Kapampangans always came “first.”
“We know how our village officials and councilmen — especially the retired — worked very hard for our fellow Kapampangans. They deserve some benefits. As to the quarry industry, naibalik natin ang para sa taong bayan at tayo ay nanindigan. It was the collaborative effort of our executive and legislative, with the help of our other officials at Capitol,” Guiao added.
Guiao likened the race in the first district as “eating fried chicken.”
“Of course, kung puro fried chicken na lang ang kinakain mo like the race in Angeles City na sila-sila na lang ang pagpapalitan, ay magsasawa ka rin. Now at least, I am presenting myself as the ‘change’ for fresh ideas. And I am confident I can bring change in the district if given the mandate,” noted Guiao.
“One team tayo na dapat sama-sama at kakampi lahat sa pagbibigay ng bagong mukha at direksyon sa primera distrito,” he said.

The SC issued on Monday a status quo ante order suspending the implementation of the RH Law for four months, with justices voting 10-5 in favor of the stop order.
No less than Chief Justice Ma. Lourdes Sereno led the dissenting group.
Aniceto, who heads the Catholic Bishops Conference of the Philippines’ (CBCP) Episcopal Commission on Family and Life, said the Church will pursue its opposition on the RH Bill and elevate their concerns to the SC.
Getting wind of the good news, Aniceto said that “heaven has heard our prayers.”
“This is very good news to all pro-life advocates. It brings hope to us who value life as embodied in the teachings of our Good Shepherd, the Lord Jesus Christ,” he said.
He added that the SC’s move will also be of good news to Pope Francis, who is against the distribution of contraceptives in Argentina when he was still a cardinal there.
“We will remain vigilant as this is just temporary,” Aniceto said. The feisty prelate has urged voters in the Archdiocese of San Fernando to go for pro-life candidates, even as he did not name names.
Oral arguments on the RH bill are set to start June 18.

Laus said police officers are in the forefront of cases and incidents dealing with abuses against women.

She said police operatives can effectively pursue cases against criminal elements victimizing women and advance the effective implementation of women’s desks in various police precincts here.

“The police are essential partners in the implementation of laws and policies on the protection of women. The more they effectively implement the law, the more people will be able to accept the fact that women’s rights are also human rights,” Laus said.

Kababaihan: Gabay sa Pagtahak sa Tuwid na Daan is this year’s theme for the Women’s Month Celebration, which underscores the need to accelerate women’s participation in governance and enhance gender perspective in upholding good governance.

The theme highlights the importance of strengthening the mechanisms and institutions that support women and to widen the arena for their participation.

Laus said the Provincial Government of Pampanga will work closely with the police in implementing policies and regulations for women’s protection in the local level.

Governor Lilia Pineda, during her first 30 months in office, implemented the construction of at least 183 classrooms with appropriate comfort rooms and six covered courts amounting to P179,242,962.

The initiative was recognized by the Department of Education (DepEd) wherein the Provincial Government was previously conferred with Adopt-A-School Program Award.

Pineda said education is another top priority of her administration, because she believes sustainable growth and development will only be achieved when the people are educated or at least given access to free education.

The Provincial Government also partnered with the Don Honorio Ventura Technological State University (DHVTSU) for an intensive delivery of scholarship grants to qualified students.

It has funded the construction of the DHVTSU Sto. Tomas satellite campus wherein some P22 million was spent by the Capitol for the renovation of the Department of Health’s abandoned building in Barangay Moras Dela Paz.

Pineda also supported the construction of a P12-million two-storey building for DHVTSU’s satellite campus in Porac town.

The Philippine State College of Aeronautics (Philsca) in Floridablanca town got some P25 million from the current administration for its building improvements to further strengthen the school’s capability in providing quality education.

From 2010 to 2012, the Provincial Government distributed around P14-million worth of scholarship grants and financial assistance to some students under the Provincial Government’s Educational Fund Assistance Program (Efap).

Each of the scholars received P5,000 per semester or a total of P10,000 for one school year except for the VisualCom beneficiaries who received P5,000 educational assistance for one semester only.

The Provincial Board at the same time passed an ordinance providing scholarship for the students who graduated valedictorian, salutatorian and first honorable mention.

In turning over the award to the City Government, Vice Mayor Edwin Santiago said the concerted effort of councilors Alex Patio, Noel Tulabut, Reden Halili, Ruping Dumlao, Ayzel Macalino, Ruping Dumlao, Lito Ocampo, Arnel Sicat, Ato Agustin and Philippine Councilors Leaguer-Pampanga Chapter president Dein Henson, in crafting and passing essential legislative measures was the “driving spirit” behind the success of the august body.

Mayor Oscar Rodriguez agreed and said that despite the members’ varying political affiliations, the City Council was able to achieve its goals and deliver results to Fernandinos.

Patio and Tulabut, majority and minority leaders, respectively, both described their sessions in the plenary as “full of debates and arguments” since they consider Fernandinos on proposed measures and every legislation passed.

“The landmark legislation in education, health, environment, infrastructure and other measures are for Fernandinos. We also have been supported by our fellow city officials as we seek to make the city truly a habitat of human excellence. The award belongs to the people of San Fernando because it is their trust and confidence in us that moves us all. We thank them so much for that,” Lazatin said.

Lazatin issued the statement in reaction to statements accusing him of alleged irregularities.

Lazatin asked Mayor Edgardo Pamintuan to focus instead on how to explain the city’s current “sorry” financial state and the illegal use of its resources by his political party Partido Abe Kampangan (PAK), rather than unearthing the debts incurred in 2003 to 2007, which are all legal and “above board.”

IC Calaguas, Lazatin’s chief political affairs officer, said the Commission on Audit (COA) stated that the projects funded by the P340.97-million loan are all intact and functional.

Among the projects funded by the Lazatin’s loans were the San Nicolas Public Market (P186 million), the construction of the Angeles City Slaughterhouse (P20 million), the computerization of Rafael Lazatin Memorial Medical Center (P10 million), construction of school buildings (P45 million), construction of socialized housing (five million), construction of the Angeles City Abattoir (P5.6 million), Internal Revenue Allotment monetization (P25.46 million), purchase of equipment and garbage bins (P43.55 million), and equipment pool (P0.36 million).

Calaguas said: “If Congressman Lazatin did incur bad credit during his term, the succeeding mayor, in this case former Mayor Francis Nepomuceno, wouldn’t have been able to acquire another P800-million loan originally intended for the construction of the sports complex.”

Calaguas also said there is no problem with local government units (LGUs) acquiring loans as long as the projects intended for the loan are accomplished.

“All the debts incurred during Congressman Lazatin’s time as mayor were approved by the City Council and the Bureau of Local Government Finance,” Calaguas said.

“We advise Mayor Pamintuan to address the issues hounding his administration first, particularly the city’s bankruptcy and his favoring his political party by allowing PAK to use the equipment of the City Government, before inventing accusations against Congressman Lazatin,” Calaguas added.

Calaguas explained the balance of the said loan, amounting to P228,447,999.57, was taken out through another loan acquired by the City Government in 2009 from the Philippine Veterans Bank (PVB).

Calaguas said that Lazatin’s term expired on June 30, 2007, but the City Government was able to obtain another loan from the PVB, amounting to P600,000,000 for the construction of the Sports Complex in October 2009.

The said P600,000,000 loan was originally intended for Sports Complex, but was diverted by Pamintuan for the construction of the still unused City College of Angeles City and the expansion of Rafael Lazatin Memorial Medical Center or Ospital Ning Angeles.

On August 13, 2009, the City Government entered into a Term Loan Facility Agreement with PVB, which is payable within a period of 12 years and divided into two tranches.

Tranche I of the loan was used to cover the city’s outstanding loans to the Land Bank of the Philippines and the Development Bank of the Philippines, while Tranche II was used to finance the then proposed Angeles City Sports Complex.

On October 9, 2009, the City Government received Tranche I of the loan amounting to P228,447,999.57 and the money was used to refinance the loans of Lazatin.

Documents obtained by Sun.Star Pampanga show that on February 12, 2013, COA chair Ma. Gracia Pulido-Tan wrote Tumang about the “FAIO [Fraud Audit and Investigation Office] Report No. 2012-010” or the “Report on the Results of the Audit on the Purported Anomalous Projects and Expenditures of the Municipality of Mexico, Pampanga for the Calendar Years 2007 to mid 2010.”

The letter was reportedly received at the Mayor’s Office in February 28, a Sun.Star Pampanga source said.

In its recommendations, the COA team led by supervisor lawyer Alexander Juliano, State auditor Desiree Aquino, and members Special Investigator IV Engr. Francisco Valentino Jr., State auditor II Deborah Araojo and State auditor I Eduardo Acosta requested Tumang to “comply strictly with the provisions of the IRR [Implementing Rules and Regulations] of Republic Act 9184 and the relevant GPPB [Government Procurement Policy Board] Resolutions in the procurements to be made by the municipality.”

The COA recommended courses of action also asked Tumang to “institute proper charges, administrative and criminal, against concerned officials and private individuals in accordance with the penal provision under Section 65 of IRR-A of RA 9184 and Section 3 (e) and (h) of RA No. 3019 and Article 171 of the Revised Penal Code.”

The audit, documents show, was requested by Vice Mayor Roy Manalastas and councilors Rex Calma, Emmanuel Manalo and Rudencio Gonzales on August 31, 2010, and was authorized under Audit Office 2010-653 dated October 4 of the same year. Its primary objective was “to determine whether the selection of contractors/suppliers for projects/expenditures and award of contracts by the Municipality of Mexico implemented in 2007 up to mid 2010 were made in accordance with RA 9184 or the “Government Procurement Act.”

In its findings discussed with municipal officials during the July 26, 2012 exit conference, the COA found out that some P43,168,403.79 for procurement of vehicles and medicines was awarded to bidders, who “had either close relationship or personal dealings with the head of the procuring entity; used the same name of another or allowed another to use one’s name for participation in biddings; and who maliciously submitted different bids through two or more persons, corporations, partnerships or any other business entity in which he has an interest, to create the appearance of competition that does not exist so as to be adjudged as the winning bidder.

The COA said the municipal Bids and Awards Committee failed to discharge its mandate as the law requires, thereby producing results that are disadvantageous to the public.

The COA also noted that the municipality went on a P39,321,098.10 contract shopping from 2007 to mid 2010, all awarded to one Buyu Trading and Construction, on the basis of irregularly filled-up canvass forms and alleged fraudulent names and signatures. The audit also disclosed that 164 disbursement vouchers totaling P26,719,162.53 were paid without the approval of the municipal accountant.

“We request that the recommendations be implemented and that this Commission be informed of the actions taken within 60 days (from receipt hereof),” the COA urged the mayor.

Sun.Star Pampanga tried to reach Tumang, but repeated calls remained unanswered, although in an interview last year, he said he would welcome the results of the audit.
