MANILA — Globe Telecom warned the government of spectrum applicants, speculators and consortia driven by “financial players” who eventually sell out for business gain.
Additional spectrum allocation rationally distributed to market competitors will benefit the consumers, so the government should ensure there is no imbalance in this resource and it is used efficiently to bring more, better and inexpensive communication services to the public, said Globe in a statement.

It added that the PLDT-Digitel deal gives PLDT and its group virtual monopoly and control of the radio frequencies, which, compared to the highways, are the modes and means of transmitting voice, data and text messages.
At the recent hearings at the Senate committee on public services, data given by National Telecommunications Commission (NTC) Commissioner Gamaliel Cordoba clearly stated that PLDT Digitel has majority 51 percent share of 3G and CMTS (cellular mobile telecommunications systems) frequencies, while Globe has a mere 23 percent share to service over 27 million subscribers.
NTC Commissioner Cordoba admitted that the State only has six percent (10Mhz) 3G frequency left for allocation, which is currently under litigation.
With this, Globe urged the government to protect and maintain free competition in the market by ensuring a level playing field that will allow consumers to choose the best services and give telco providers equal opportunities to compete.
Globe pointed out that the merger will result in an imbalance in market share and scarce frequency resources that will affect free competition and services to millions of subscribers, among others.
It also explained that the assignment of radio frequencies directly relate to the ability of service providers to efficiently use this scarce resource through capital and infrastructure investments.
Bayan Muna Representative Teddy Casiño, in his privilege speech Monday, explicitly pointed to PLDT-Digitel’s overwhelming 71 percent market share, a telco behemoth that will monopolize the market.
“This abhorrence of monopolies is enshrined in the Constitution. Section 19, Article XII of the 1987 Constitution states: ‘The State shall regulate or prohibit monopolies when the public interest so requires. No combinations in restraint of trade or unfair competition shall be allowed,” said Casiño.
The congressman added, “A deal that would reverse the policy of demonopolization (in reference to Republic Act 7925) in the telecommunications industry was certainly not contemplated by previous Congresses and should not be tolerated by the 15th Congress.”
At Wednesday’s Senate hearing, Casiño reiterated, “This is the spirit of RA 7925 to slay the monster of PLDT’s stranglehold in the industry in the past. We should not bring back the monster we wanted slain in the first place.”
In the same Senate hearing, Globe chief legal counsel, Rodolfo Salalima warned that if the government allows the PLDT-Digitel deal to go through without correcting its frequency allocation, this deal violates the NTC Memorandum Circular 07-08-2005 (Rules and Regulations on the Allocation and Assignment of 3G Radio Frequency Bands).
The memorandum circular states that “entities with more than 50 percent of common stocks owned by the same person or group of persons shall be considered as associated applicants, at the time of application, and such entities shall be allowed to elect one of them to proceed in the filing of application for 3G services and 3G radio spectrum before the Commission.”
The consolidation of PLDT and Digitel will result in a lopsided imbalance of spectrum allocation in their favor, Globe said.
Globe serves 27.3 million subscribers with only 99 MHz, while Smart and Sun will effectively serve 60 million subscribers with 372 MHz. This means Globe is serving 276,000 subscribers for every 1 MHz of spectrum it has, while Smart and Sun will only address 161,000 subscribers for their every 1 MHz of spectrum.
Particularly in 3G cellular service, the ratio of PLDT to Globe’s allocation is 4.5:1, a clear disservice to millions of Globe subscribers at present.
“If PLDT-Digitel is saying they need all the frequency they have with only 60 million subscribers, Globe subscribers are also entitled to a fair share of the State’s frequencies which they should enjoy through better products using more advanced technology. Globe has only 10 MHz to serve 27 to 30 million subscribers, then PLDT should only have 23 MHz for its 60 million subscribers. PLDT should divest of its unused 22 MHz frequency they currently have,” said Salalima.
Globe intends to continue investing aggressively in the infrastructure needed to provide superior service to the public, addressing its growing needs for access, bandwidth and connectivity. These services support knowledge-empowerment, education, micro-finance and the country’s booming business process outsourcing industry, among others, and will benefit public interest.

Manila, Philippines – Metro Pacific Investments Corp. (MPIC) has asked government for “flexibility” in the determination of tariff rates for the multi-billion peso connector road project that will connect the North and South Luzon Expressways.
This developed after Department of Justice (DOJ), in a recent legal opinion, said that government’s assumption of the costs for securing the right-of-way for MPIC and wholly-owned subsidiary Metro Pacific Tollways Corp. (MPTC) is a form of subsidy to the private sector which should not be allowed.
MPIC chairman Manuel V. Pangilinan said the right-of-way cost for the connector road project from McArthur Highway in Valenzuela in the north to Buendia in Makati in the south is about P7 billion.
Pangilinan also revealed that MPIC subsidiary Maynilad will be spending about P10 billion every year for capital expenditure. Maynilad is also investing around P2 billion to expand Pututan’s capacity from 100 million liters per day to 300 MLD to provide an alternative source of water to Angat. “We are also conducting water demand studies and identifying new sources of bulk water,” he added. The Pututan water treatment facility draws raw water from Laguna Lake and is the first large-scale alternative water source to Angat for Metro Manila.
Maynilad president Victorico Vargas said Pututan’s expansion to 300 MLD will be completed in 2013.
Meanwhile, Pangilinan said if MPTC were to absorb the cost for securing the right-of-way, that would mean an increase in the project cost for Segments 9, 10 and 11 from P27 billion to P34 billion (of which P17 billion is for the connector road and P7 billion for the right-of-way).
The connector road is a 13.5-kilometer project that was granted original proponent status by the DPWH based on MPTC’s unsolicited bid. It will connect NLEX to SLEX via an elevated road over the tracks of the Philippine National Railways (PNR).
MPTC expects the auction for the connector road to be launched in the second half of the year.
He noted that the DOJ opinion “puts a chill” on railway, tollway, bridges, and even airport projects.
Pangilinan noted that MPIC’s assumption when it submitted the proposal to the Department of Works and Highways (DPWH) to undertake the connector road project, and that the typical public-private partnership (PPP) approach, is that the government is the one who secures the right-of-way as its “equity” in the project since the private sector does not have expropriation rights.
“The project cost we offered to absorb is P27 billion which is bulk of the cost and therefore not a bad share,” Pangilinan said.
He emphasized that they just need clearer ground rules. “If the thrust of the DOJ ruling is that government cannot subsidize the right-of-way costs and that it is the private sector who should pay for it, then government should allow us to have more flexibility in the tariffs and to input that in the tariff calculation,” Pangilinan added.
“If government believes it is a subsidy to the private sector and that we should shoulder it, then that is ok with us. But we have to be flexible with the tariff,” Pangilinan, who is also managing director and CEO of Hong Kong-based First Pacific Co., emphasized.
The tariff rate adjustment flexibility will allow MPTC to structure its rates to reflect the added project cost and to recover it.
Also yesterday, MPIC president Jose Ma. Lim said they have already submitted a proposal with their Japanese partners who will try to raise additional foreign investments for the connector road project.
MPTC president Ramoncito Fernandez said they are currently working with government for the acquisition of rights-of-way for Segment 9 or the Harbour Link (connecting Valenzuela to the Harbour area in Manila). MPTC has also signed a memorandum of understanding with PNR and North Luzon Railways Corp. (Northrail) to coordinate on the design of the second half (Segment 10) of the Harbour Link which is going to be elevated over their tracks.
Fernandez added that other projects they are looking at include tollroad projects in the provinces, ongoing discussions with shareholders of both Skyway and SLEX, and two of the PPP projects announced by government, namely CALA Expressway and NAIA 2 Expressway.
He noted that for MPTC, this year’s results will be influenced by three things – the final resolution of VAT on toll fees, increase in fuel cost, and expiry of the Manila North Tollways Corp. (MNTC) tax holiday in 2010.
“Core income should be relatively flat given the impact of income tax. While we cannot speculate on how the Supreme Court will rule on the VAT issue, the impact of a sustained increase in gas prices could be significant. Toll revenues should show double digit growth but the effect of income taxes on our bottomline numbers will be significant,” he said.
MPTC also plans to spend about P300 million to integrate the Subic-Clark-Tarlac Expressway (SCTEX) to NLEX about 12 months from takeover, but turnover by the Bases Conversion Development Authority (BCDA) has been delayed because the latter’s new management wants a renegotiation of the already signed and approved SCTEX concession agreement with MNTC.
Pangilinan said they have 60 days or until June 30 to conduct the renegotiations.

MANILA, Philippines – Typhoon “Chedeng” (international name Songda) intensified yesterday but changed direction, hugging the eastern seaboard as it moved away from the country, the Philippine Atmospheric, Geophysical and Astronomical Services Administration (PAGASA) said.
PAGASA supervising undersecretary Graciano Yumul said Chedeng would still bring heavy rains and gusty winds over the provinces of Ilocos Norte, Ilocos Sur, Benguet,
Ifugao, Kalinga, Apayao, Isabela, Nueva Ecija, Nueva Vizcaya, Cagayan Valley, Quirino and Aurora until the weekend.
“It has a big radius, so it can affect many areas even if it does not make landfall,” said forecaster Mario Palafox.
As of 5 p.m. yesterday, storm warning signal number 1 was still hoisted over Catanduanes, Camarines Sur, Camarines Norte, Albay, Quirino, Aurora, Quezon province, including Polillo Islands, Isabela and Cagayan.
As of 4 p.m., the eye of Chedeng was spotted 260 kilometers north northeast of Virac, Catanduanes, or 300 kms southeast of Casiguran, Aurora packing winds of 175 kilometers per hour (kph) near the center and gustiness of up to 210 kph.
Chedeng was forecast to move northwest at 19 kph.
It is predicted to be 320 kms northeast of Casiguran, Aurora or 200 kms east northeast of Aparri, Cagayan this afternoon and about 590 kms northeast of Basco, Batanes or 190 kms southwest of Okinawa, Japan tomorrow afternoon.
PAGASA weather division chief Robert Sawi said the high-pressure area blocking Chedeng’s path had weakened, causing the typhoon to change direction and move from north-northwest to northwest.
PAGASA’s forecasts last Monday and Tuesday showed that Chedeng would make landfall over Isabela-Cagayan area on Friday.
Its Wednesday forecast showed Chedeng would hit the area of Aurora-Isabela on Friday.
“The good news is the typhoon is moving away from the country,” Yumul told a press briefing.
Sawi added Chedeng was expected to dump heavy rains of more than 100 millimeters over the eastern coast of Central Luzon.
Chedeng would also continue to bring rains over the western side of the Visayas and Southern Luzon yesterday, he added.
By Friday morning, heavy rains are forecast over extreme northern Luzon, he said.
Sawi said the southwest monsoon would be the dominant system beginning Saturday and will bring rains over the western section of Visayas and Southern Luzon, including Metro Manila, on Saturday and Sunday.
Sawi said the prevalence of the southwest monsoon this weekend signals the onset of the rainy season in the country.
On the other hand, Yumul told dzMM radio that the rains being experienced in the western seaboard of Luzon and Visayas, including Metro Manila, are not due to Chedeng but are due to an active inter-tropical convergence zone.
Yumul said that starting late Friday through the weekend, the area would experience rains due to the southwest monsoon, which will be drawn to the area by Chedeng as it moves towards southern Japan.
Casualty
The rains apparently induced by the southwest monsoon reportedly left a 79-year old man dead, with two more missing in the Bicol region.
Office of Civil Defense (OCD) regional director Raffy Alejandro identified the lone casualty as Jaime Torrellos, who was swept away while crossing a river in Gigmoto town on Wednesday while storm signal no. 2 was hoisted over the region.
Alejandro said they are verifying reports of two fishermen who went missing in Vinzons, Camarines Norte and in Gigmoto town.
As the typhoon moved away, Albay Gov. Joey Salceda yesterday allowed the thousands of evacuees to go home.
Salceda though ordered 21,000 families from the towns of Oas and Libon to stay put in the evacuation centers, citing the danger posed by landslides in their areas because of the heavy rains.
Salceda earlier sent military trucks to begin moving 250,000 residents from coastal and landslide-prone villages and areas in the path of debris from Mayon volcano. He also offered five kilograms of rice as an incentive for each family that evacuates.
The National Disaster Risk Reduction and Management Council (NDRRMC) said 13,322 families or 63,964 persons from 152 barangays in Albay province were evacuated.
NDRRMC and Office of Civil Defense (OCD) chief Benito Ramos said an estimated 49,893 families or 250,425 residents from 497 villages in the province are also being targeted for possible evacuation in the event the typhoon would shift course and hit the region.
Ramos said they would not order a pull out of disaster response teams even if Chedeng would no longer make landfall.
Ramos said the teams would remain in the Bicol region for 12 hours after Chedeng leaves the Philippine area of responsibility.
Government offices in the region were closed and flights were canceled. More than 7,000 people were stranded in ports after the Coast Guard barred sea travel in areas with typhoon warnings.
In other provinces leading up to northern Luzon and Metro Manila, officials have collected rubber boats and food supplies and put rescuers on standby. The Coast Guard also deployed its rescue teams in northern Luzon.
Pangasinan Gov. Amado Espino ordered local officials to make preparations and pre-emptive measures against flooding.
The Mines and Geo-Sciences Bureau (MGB) of the Department of Environment and Natural Resources in the Cordillera Administrative Region (CAR) has raised warnings against possible landslides in the region with the onset of heavy rains brought by Chedeng.
The MGB stressed Apayao, Benguet, Ifugao, Kalinga and Mountain Province are among the top 10 provinces in the country that are prone to landslides and floods.
The province of Benguet is the most affected province in the region, with over 90 percent of its total land area prone to landslides, the MGB said.
The Metropolitan Manila Development Authority (MMDA) also went on “blue alert” in deploying rescue units and equipment as part of the disaster preparations in Metro Manila.
MMDA chairman Francis Tolentino said they are expecting Chedeng to dump heavy rains in Metro Manila like that of tropical storm “Ondoy” in 2009.
PAGASA said Chedeng could trigger heavy rains in the next few days even as the typhoon had spared the country.
