No detention for lawyer cited in contempt

MANILA — Lawyer Vitaliano Aguirre, cited for contempt by the Senate impeachment court, can unpack his overnight bag: the Senate has decided it will not have him detained after all.
Senate President Juan Ponce Enrile said Aguirre, who earned a contempt citation for covering his ears while Senator Miriam Defensor-Santiago was scolding the prosecution panel, will be admonished instead.
“The impeachment court, although there is evidence of an act that may be considered contemptuous of the court, would not impose a penalty with respect of freedom on Attorney Aguirre,” Enrile announced at a short briefing after a caucus Tuesday afternoon. He said this was because of “unusual circumstances surrounding the incident.”
Enrile declined to elaborate, saying “it is up to you to interpret that.”
Aguirre was cited for contempt on February 29 on the strength of a motion by Santiago. This was seconded by Senator Pia Cayetano and was carried unopposed. Contempt usually carries a fine of up to P2,000, detention of up to 10 days, or both.
Some senators had joked that Aguirre could be detained for 24 hours and made to listen to recordings of Santiago’s speeches. Santiago, in a phone-patch interview with senators last week, said she was inclined to go with this suggestion.
Earlier Tuesday, a group of Aguirre’s supporters wearing shirts printed with the picture of the lawyer covering his ears, camped outside the Senate to wait for the Senate to decide his punishment. They were led by lawyer Andrew Aguirre, Vitaliano Aguirre’s son.
Aguirre filed a motion to withdraw as a member of the prosecution panel on Monday. Enrile said the admonition will simply be entered into the record of the impeachment court.
